TITLE: AN ORDINANCE AMENDING VARIOUS SECTIONS OF APPENDIX A, ZONING
ORDINANCE, OF THE WHEAT RIDGE CODE OF LAWS, CITY OF WHEAT RIDGE,
COUNTY OF JEFFERSON, STATE OF COLORADO, RELATING TO MULTIFAMILY
RESIDENTIAL DEVELOPMENT REQUIREMENTS AND LANDSCAPING REQUIREMENTS, AND
CONSOLIDATION OF MULTIPLE PARCELS FOR DEVELOPMENT.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT:
Section 1. Wheat Ridge Code of Laws, Appendix A, Section 10.,
Residential-Three Zone District, D.4., Side Yard, is hereby amended to read as
follows:
"Side Yard. The minimum width of side yard for one or two family
structures and/or accessory structures shall be five (5) feet per
story. The minimum width of side yard for multiple family structures
shall be fifteen (15) feet for the first story and an additional five
(5) feet for each additional story. The minimum side yard setback for
any structure adjacent to a dedicated public street shall be thirty
(30) feet."
Section 2. Wheat Ridge Code of Laws, Appendix A, Section 10.1
Residential-Three Zone District, D.5., Rear Yard, is hereby amended to read as
follows:
"Rear Yard. The minimum width of rear yards for one or two family
structures and/or accessory structures shall be five (5) feet per
story. The minimum width of rear yards for multiple family structures
shall be fifteen (15) feet for the first story and an additional five
(5) feet for each additional story."
Section 3. Wheat Ridge Code of Laws, Appendix A, Section 10.1
Residential-Three Zone District, D.6., Lot Coverage, is hereby amended to read
as follows:
"Lot Coverage. Not more than seventy-five (75) per cent of the gross
lot area shall be covered by the main building, accessory building
and/or paving. All other areas are to be landscaped."
Section 4. Wheat Ridge Code of Laws, Appendix A, Section 11., Residential

Section 7. Wheat Ridge Code of Laws, Appendix A, Section 27.2., Landscape
Requirements, Subsection A., Definition, is hereby amended by the addition of
the following:
"Sidewalks, whether paved or gravel, which serve as functional links
between parking areas and main structures, or which serve as general
public access routes around a main structure, or between a main
structure and a public street or alley, shall not be counted as
landscaping. Other sidewalks or paths which serve as casual access
to, or through landscape areas may be counted as non-living landscape
features."
Section 8. Wheat Ridge Code of Laws, Appendix A, Section 27, Regulations
Applicable to All Districts, is hereby amended to include the following new
Subsection B.3., Development on Multiple Parcels or Lots.
B.3. Development on Multiple Parcels or Lots.
a. Intent and Purpose
It is the intent of the City of Wheat Ridge that Planning
Commission and City Council reserves the right to review develop-
ment projects for any proposed new development, redevelopment,
additions or expansions, except single family residential, wherein
that development entails the aggregation or consolidation of two
(2) or more lots or parcels of land or portions thereof, in order
to accommodate the proposed development. Anyone proposing such
shall be required to submit a Consolidation Plat, and in some
instances a Site Development Plan, for approval. The purpose of
these provisions is to avoid the construction of overly large
buildings which may negatively impact surrounding neighborhoods by
obstructing light and air and by making access for fire protection
difficult; to prevent construction of one large building to avoid
compliance with the Subdivision Regulations, and to encourage
construction of smaller buildings which could give opportunities
for better design of setbacks, landscaping, parking, vehicular and
pedestrian circulation, and drainage facilities.
b. Scope
The procedures and provisions set forth in this subsection shall
be applicable to all Zone Districts except the Planned Residential
Development (PRD), Planned Commercial Development (PCD), and
Planned Industrial Development (PID) Zone Districts, as those
districts provide for subdivision review at time of plan approval.
These provisions shall not be applicable to one family dwellings.
A consolidation plat shall be filed in the form of, and following
the same requirements and approval procedures as a subdivision
(for consolidation of more than four (4) lots or parcels), or a
minor subdivision (for consolidation of 2, 3, or 4 lots or
parcels).
In addition to the requirement of filing a Consolidation Plat for
review and approval, a Site Development Plan shall be required to
be submitted for review and approval in the R-3, R-3A, H-1, H-2,
and PF-1 Zone Districts, where parcel or lot consolidation for
site development is proposed. Such Site Development Plan shall be
filed in the form of, and follow the same requirements and
approval procedures as a Planned Building Group (PBG), even if
only a single structure is proposed."
Section 9. Safety Clause. The City Council hereby finds, determines, and
declares that this ordinance is promulgated under the general policy power of
the City of Wheat Ridge, that it is promulgated for the health, safety, and
welfare of the public, and that this ordinance is necessary for the
preservation of health and safety and for the protection of public convenience
and welfare. The City Council further determines that the ordinance bears a
rational relation to the proper legislative object sought to be attained.

Section 10. Severability. If any clause, sentence, paragraph, or part of
this ordinance or the application thereof to any person or circumstances shall
for any reason be adjudged by a court of competent jurisdiction invalid, such
judgment shall not affect, impair or invalidate the remainder of this
ordinance or its application to other persons or circumstances.
Section 11. This ordinance shall take effect 15 days after final
publications.

this 17th day of June , 1985, ordered published in full in a
newspaper of general circulation in the City of Wheat Ridge and Public Hearing
and consideration on final passage set for July 8 , 1985, at 7:30
o'clock p.m., in the Council Chambers, 7500 West 29th Avenue, Wheat Ridge,
Colorado.
READ, ADOPTED AND ORDERED PUBLISHED on second and final reading by a vote of
