TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF REZONING FROM
COMMERCIAL-ONE, RESIDENTIAL-TWO, AND AGRICULTURAL-ONE
TO PLANNED COMMERCIAL DEVELOPMENT, FOR APPROVAL OF Ali OUTLINE
DEVELOPMENT PLAN, AND FOR ESTABLISHMENT OF PERMITTED USES ON
PROPERTY LOCATED SOUTHEAST OF WEST 44TH AVENUE AND YOUNGFIELD
STREET, CITY OF WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF
COLORADO.
BE IT ORDAINED BY PHE CITY COUNCIL OF THE CIPY OF WHEAT RIDGE,
COLORADO, THAT:
Section 1. Upon application by Kunz Construction Company for Ralph
and Evangeline Mangone for approval of rezoning, approval of an
Outline Development Plan and approval of permitted uses in Wheat
Ridge, Colorado, Case No. WZ-85-10, and based upon recommendation for
approval from the Wheat Ridge Planning Commission, and pursuant to
findings made based on testimony and evidence presented at public
hearing before the Wheat Ridge City Council, Wheat Ridge maps are
hereby amended to exclude from the Commercial-One, Residential-Two
and Agricultural-One Districts and to include in the Planned
Commercial Development District, the following described land:
A parcel of land in Section 20, Township 3 South, Range 69 'west
of the 6th Principal Meridian, located in Jefferson County,
Colorado, and described as follows: Beginning at a point whence
the center corner of Section 20, Township 3 South, Range 69 West
bears S51029'1011E a distance of 888.0 feet; thence S00101E,
225.0 feet; thence 300061E, 31.7 feet, thence 300321E, 81.7
feet; thence S890501W, 295.65 feet to a point from whence the
center corner of said Section 20 bears 382052'3011E, 994.3 feet;
thence N29021'15"E, 233.70 feet, thence N890501E, 52.91 feet;
thence NO0101W, 91.10 feet; thence N29021115"E, 122.90 feet;
thence N67036'54"E, 71.40 feet to the point of beginning.
Section 2. Conditions. The use of the property shall be limited to
those conditions specified on the approved Outline Development Plan
and subsequently approved Final Development Plan.
Section 3. Safety Clause. The City Council hereby finds, determines
and declares that this ordinance is promulgated under the general
police power of the City of Wheat Ridge, that it is promulgated for
the health, safety, and welfare of the public, and that this
ordinance is necessary for the preservation of health and safety
and for the protection of public convenience and welfare. The City
Council further determines that the ordinance bears a rational
relation to the proper legislative object sought to be attained.
Section 4. Severability. If any clause, sentence, paragraph, or
part of this ordinance or the application thereof to any person or
circumstances shall for any reason be adjudged by a court of
competent jurisdiction invalid, such judgment shall not affect,
impair or invalidate the remainder of this ordinance or its
application to other persons or circumstances.
Section 5. This ordinance shall take effect 15 days after final
publication.

INTRODUCED, READ, AND ADOPTED on first reading by a vote of 7
to 1 on this 25th day of November , 1985, ordered
published in full in a newspaper of general circulation in the City
of Wheat Ridge and Public Hearing and consideration on final passage
set for December 16 , 1985, at 7:30 o'clock p.m., in the Council
Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado.
