TITLE: AN ORDINANCE VACATING A PORTION OF OWENS STREET IN
THE BICKLEY SUBDIVISION WITHIN THE CITY OF WHEAT
RIDGE, COUNTY OF JEFFERSON, STATE OF COLORADO.
WHEREAS a portion of the Bickley Subdivision, previously
approved by the Board of County Commissioners of Jefferson
County, contains a dedication for Owens Street adjacent to Lot 15
of said Bickley Subdivision;
WHEREAS a portion of said dedicated Owens Street lies North
of West 36th Avenue, and cannot be used for public roadway
purposes; and
WHEREAS said part of said Owens Street lies within the City
of Wheat Ridge, County of Jefferson, State of Colorado, and is
not needed by the City for roadway or right-of-way purposes;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT
RIDGE, COLORADO AS FOLLOWS:
Section 1. The following portion of Owens Street, a
dedicated street within the City of Wheat Ridge, County of
Jefferson, State of Colorado, within the Bickley Subdivision, is
hereby vacated, to wit:
Beginning at a point on the Easterly boundary line of
n Lot 15 of Bickley Subdivision, said point being 20 feet
- South of the Northeast corner of Lot 15; thence South
z 0° 09.2' West a distance of 73.25 feet along the
Easterly property line of said Lot 15 to the Southeast
ry ti N corner of said Lot 15; thence South 89° 50.8' East a
U- < distance of 25 feet (more or less) to a point on the

o Easterly boundary line of the Bickley Subdivision;

41.44 feet; thence North 73° 58.7' West a distance of 4

c ='s Providing, however, that there is reserved to the City of Wheat Ridge
solely for the future benefit of utility providers and not for street
purposes, an easement in and from property described herein which
easement may be utilized solely for utility installation and
maintenance.
Section 2. Upon the vacation accomplished hereby, titled to
the property vacated shall revert by operation of C.R.S. 1973,
43-2-302 to the owner of record of Lot 15, Bickley Subdivision.
Section 3. Safety Clause. The City Council hereby finds,
determines, and declares that this ordinance is promulgated under
the general police power of the City of Wheat Ridge, that it is
promulgated for the health, safety, and welfare of the public,
and that this ordinance is necessary for the pr.e3ervation of
health and safety and for the protection of public convenience
and welfare. The City Council further determines that the
ordinance bears a rational relation to the proper legislative
object sought to be attained.
Section 4. Severability. If any clause, sentence,
paragraph, or part of this ordinance or the application thereof
to any person or circumstances shall for any reason be adjudged
by a court of competent jurisdiction invalid, such judgment shall
not affect application to other persons or circumstances.
Section 5. This ordinance shall take effect 1 day after
final publication.
INTRODUCED, READ, AND ADOPTED on first reading by a vote of _
to 0 on this 9th day of December , 1985,
ordered published in full in a newspaper of general circulation
in the City of Wheat Ridge and Public Hearing and consideration
on final passage set for January 13 , 1986, at
7:30 o'clock p.m., in the Council Chambers, 7500 West 29th
Avenue, Wheat Ridge, Colorado
READ, ADOPTED, AND ORDERED PUBLISHED on second and final
reading by a vote of 8 to 0 this 13th day of January
198 6.
