BE IT ORDAINED BY THE CITY COUNCIL OF Ti1E CITY OF WHEAT RIDGE, COLORADO, THAT: Section 1: Upon application by Roy Swenson for approval of a pecia se Permit in Wheat Ridge, Colorado, Case No. SUP-86-2, and based upon recommendation for approval, with conditions, from the Wheat Ridge Planning Commission, and pursuant to findings made based on testimony and evidence presented at public hearing before the Wheat Ridge City Council, Wheat Ridge maps are hereby amended to designate approval of a Special Use Permit to allow Hajor Mechanical Automotive Repair in a Commercial-One Zone District, for the following described land: A tract of land located in Lot 4, Anel Subdivision, more particularly described as follows: Beginning at a point on the South line of said Lot 4 which is 114 feet West of the Southeast corner of said lot; thence north and parallel with the East 'Line of said Lot a distance of 100 feet; thence West and parallel with the South line of said Lot a distance of 125 feet, more or less, to a point on the West line of said Lot; thence South along the West line of said Lot, a distance of 35 feet to a point of curve; thence on a 15 foot radius curve to the left a distance of 23.56 feet to the point of tangency of said curve which is on the South line of said Lot 4; thence East along said South line a distance of 110 feet, more or less to the point of beginning, County of Jefferson, State of Colorado. Section 2. Conditions. 1. Any addition to tike building be tie same manner of construction as the existing building. 2. That sound attenuation be provided along the north wall of the existing bays and proposed addition. 3. That curb, ,utL-r and sidewalk be provided on this development either at time of construction or a letter of intent be submitted to the City to be done at a time that is most convenient for the City. 4. This permit allows major mechanical repair of automobiles and small trucks totally within the building. Body repair and painting not permitted. Section 3. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative object sought to be attained. Section 4. Severability. If any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect, impair or invalidate the remainder of this ordinance or its application to other persons or circumstances. ORDIUANCE 1,10. 663 PAGE 2 Section 5. This ordinance shall take effect 15 days after final publication. INTRODUCED, READ, AND ADOPTED on first reading by a vote of 8 to ~0 on this 28th day of April , 1986, ordered published in full in a newspaper of general circulation in the City of Wheat Ridge and Public Tearing and consideration on final passage set for May 19 , 1986, at 7:30 o'clock p.m., in the Council Chambers, 7500 'Nest 29th Avenue, Wheat Ridge, Colorado.
