ORDINANCE NO. 668
Series of 1986
TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF REZONING FROM
AGRICULTURAL-ONE TO COMMERCIAL-ONE ON LAND LOCATED AT THE
NORTHEAST AND NORTHWEST CORNERS OF WEST I-70 FRONTAGE ROAD
NORTH AND PARFET STREET, CITY OF WHEAT RIDGE, COUNTY OF
JEFFERSON, STATE OF COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO, THAT:
Section 1. Upon application by James M. Sullivan for approval of
rezoning in Wheat Ridge, Colorado, Case No. WZ-86-10 and pursuant
to findings made based on testimony and evidence presented at
public hearing before the Wheat Ridge City Council, Wheat Ridge
maps are hereby amended to exclude from the Agricultural-One
District and to include in the Commercial-One District, with
conditions, the following described land:
PARCEL I
A tract of land being a portion of the southeast quarter of the
southwest quarter of Section 16, Township 3 South, Range 69
West of the Sixth Principal Meridian, County of Jefferson,
State of Colorado, being more particularly described as
follows:
Beginning at the northwest corner of the southeast quarter of
the southwest quarter of Section 16; thence N8904314611E along
the north line of said southeast quarter of the southwest
quarter 750.07 feet to a point on the westerly right-of-way of
Parfet Street; thence SO000111211W, along said westerly
right-of-way, 992.07 feet to a point on the southerly boundary
line of the Denver and 'lorthwestern Railroad Company
right-of-way as recorded in Book 126 Page 583 in the Recorder's
Office of Jefferson County; then 574007'31111W along said
southerly right-of-way, 99.96 feet to a point on the northerly
right-of-way of Interstate 'Iighway 70 as recorded under Book
1909, Page 161 in the Recorder's Office of Jefferson County;
thence along said northerly boundary line the following two (2)
courses:
(1) Thence 389040'3611W, also being parallel with the south
line of the SE 1/4 of the SW 1/4 of Section 16, 467.55
feet to a point of curvature;
(2) Thence along a curve to the left having a central angle of
0501010411, a radius of 2060.00, an arc length of 185.80
feet to a point on the west line of said southeast
quarter, of the southwest quarter;
Thence N0000111611W along said west line of 1027.92 feet to the
point of beginning, containing 1"7.522 acres more or less.
PARCEL II
A tract of land being a portion of the southeast quarter of the
southwest quarter of Section 16, Township 3 South, Range 69
[west of the 6th Principal Meridian, County of Jefferson, State
of Colorado, being more particularly described as follows:
Commencing at the southeast corner of the southwest quarter of
Section 16; thence N0900111211E along the east line of the
southeast quarter of the southwest quarter of Section 16,
448.01 feet to a point on the southerly boundary line of the
Denver and Northwestern Railroad Company right-of-way as
recorded in Book 126, Page 523 in the Recorder's Office of
Jefferson County, said point being the point of beginning;
thence 574007'3411W along said right-of-way, 549.33 feet to a
point on the easterly right-of-way of Parfet Street; thence
N0000111211E, along said easterly right-of-way, 730.58 feet to a
point being 247.50 feet southerly of the north line of the
southeast quarter of the southwest quarter of Section 16;
thence N8904314611E, parallel with and 247.50 feet distant when
measured at right angles to said north line 58.33 feet to a
point on the east line of the southeast quarter of the
southwest quarter of Section 16; thence S0000111211W, along said
east line 582.83 feet to the point of beginning, containing
7.965 acres more or less.

Section 2. Conditions.

1. The east ill of Parcel I is subject to the use and desin as
per the adopted Craig Chevrolet-Official Development Plan.
2. The oalance of land included within this change of zone is
subject to Site Plan approval, including limitation of
allowable uses, by Planning Commission and City Council prior
to any change from the presently maintained use.
Section 3. The City Council hereby finds, determines, and declares
that this ordinance is promulgated under the general police power
of the City of' Wheat Ridge, that it is promulgated for the health,
safety, and welfare of the public, and that this ordinance is
necessary for the preservation of health and safety and for the
protection of public convenience and welfare. The City Council
further determines that the ordinance bears a rational relation to
the proper legislative object sought to be attained.
Section 4. Severability. If any clause, sentence, paragraph, or
part of this ordinance or the application thereof to any person or
circumstances shall for any reason be adjudged by a court of
competent jurisdiction invalid, such judgment shall not affect,
impair or invalidate the refflainder of this ordinance or its
application to other persons or circumstances.
Section 5. This ordinance shall take effect 15 _ days after final
publication.
