BE IT ORDAINED 3Y THE CITY COUNCIL OF THE CITY OF 44HEAT RIDGE, COLORADO, THAT: Section 1. Upon application by James Muff for approval of rezoning in Wheat Ridge, Colorado, Case No. WZ-86-8, and based upon recommendation for approval from the Wheat Ridge Planning Commission, and pursuant to findings made based on testimony and evidence presented at public hearing before the Wheat Ridge City Council, Wheat Ridge maps are hereby amended to exclude from the Agricultural-One District and to include in the Planned Commercial Development District and for approval of an Outline Development Plan the following described land: The North 134 feet of the E 112 of Lot 9, Lees' Subdivision, Jefferson County, Colorado, and one inch of water in the Lane Ditch, and all water and water rights appertaining thereto and all improvements thereon. A parcel of land located in the E 112 of the Lot 9, Lees' Subdivision, Jefferson County, Colorado, being more particularly described as follows: Beginning at the Northeast corner Subdivision, with a pin and plastic cap Thence bearing 300013154"E a distance and plastic cap stamped LS-9132, Thence bearing S39024153"W a distance and plastic cap stamped LS-9231, Thence bearing N0001115211w a distance and plastic cap stamped LS-18974, Thence bearing; N89024'5311E a distance Point of Beginning. of said Lot 9, Lees' stamped LS-189714, of 134.00 feet to a pin of 321.80 feet to a pin of 134.00 feet to a pin of 321.72 feet to the Parcel contains 0.99 acres, more or less. Section 2. Safety Clause. The City Council hereby finds, determines, and declares that this Ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public and that this Ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the Ordinance bears a rational relation to the proper legislative object sought to be attained. Section 3. Severability. If any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect, impair or invalidate the remainder of this ordinance or its application to other persons or circumstances.
