TITLE: AN ORDINANCE VACATING CERTAIN REAL PROPERTY PREVIOUSLY
CONVEYED TO THE CITY FOR STREET PURPOSES
WHEREAS the City of Wheat Ridge, by Quit Claim Deed dated
December 18, 1969, accepted the conveyance of certain properties
for use for road purposes only;
WHEREAS the Wheat Ridge City Council, on September 13, 1982,
approved the Container Systems Minor Subdivision, which Minor
Subdivision replatted the property previously conveyed by the
above described Quit Claim Deed, and called for the "road to be
vacated";
WHEREAS the City has never formally vacated the road
property heretofore accepted by the City;
WHEREAS the City does not need said property for road
purposes, and thereby wishes to vacate the same;
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WHEAT RIDGE, COLORADO AS FOLLOWS:
Section 1. Pursuant to C.R.S. 43-2-301 et sue., the City
Council does hereby vacate the following described real property
situate, lying, and being in the County of Jefferson, State of
Colorado, to wit:
A parcel of land in the NW1/4 SE1/4, Section 16,
Township 3 South, Range 69 West of the 6th P.M.
described as follows:
Beginning at the Southwest corner of said NW 1/4
SE 1/4; thence North along the West line of said
NW 1/4 SE 1/4 a distance of 1226.42 feet more or less
to the Southerly right-of-way line of the Colorado and
Southern Railroad; thence Northeasterly along said
right-of-way line to a point that is 40 feet East of
said West line; thence South and parallel to said West
line to a point that is 400 feet North of the South
line of said NW 1/4 SE 1/4; thence on a curve to the
left, with radius of 360 feet and center 400 feet North
and 400 feet East of said Southwest corner, a distance
of 542.24 feet; thence South and parallel to said West
line 40.27 feet more or less to a point on the South
line of said NW 1/4 SE 1/4; thence West along said
South line 376.72 feet more or less to the point of
beginning--containing 2.07 acres more or less, Except
the southern most forty feet thereof.
Section 2. Upon the adoption of this ordinance, title to
the property vacated hereby shall revert to N.R. Petry Co., or
its successor owner of the remaining property contained within
the Container Systems Minor Subdivision.
Section 3. Severability. If any clause, sentence,
paragraph, or part of this ordinance or the application thereof
to any person or circumstances shall for any reason be adjudged
by a court of competent jurisdiction invalid, such judgment shall
not affect application to other persons or circumstances.
Section 4. Safety Clause. The City Council hereby finds,
determines, and declares that this ordinance is promulgated under
the general police power of the City of Wheat Ridge, that it is
promulgated for the health, safety, and welfare of the public,
and that this ordinance is necessary for the preservation of
health and safety and for the protection of public convenience
and welfare. The City Council further determines that the
ordinance bears a rational relation to the proper legislative
object sought to be attained.
Section 4. This ordinance shall take effect one (1) day
after final publication.
