TITLE: AN ORDINANCE REPEALING AND REENACTING SECTION 5-37 OF
THE CODE OF LAWS OF THE CITY OF WHEAT RIDGE, COLORADO,
ADOPTING BY REFERENCE THE UNIFORM CODE FOR THE
ABATEMENT OF DANGEROUS BUILDINGS, 1985 EDITION,
COPYRIGHT 1985 AND PROVIDING PENALTIES FOR VIOLATION
THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT
RIDGE, COLORADO:
Section 1. Section 5-37 of the Code of Laws of the City of
Wheat Ridge, Colorado is hereby repealed and reenacted as
follows:
The Uniform Code for the Abatement of Dangerous
Buildings 1985 Edition, copyright 1985, by the
International Conference of Building officials, is
hereby adopted by reference and incorporated into this
article as though fully set forth herein as the Code of
the City of Wheat Ridge for the Abatement of Dangerous
Buildings. Three (3) copies of said Uniform Code for
the Abatement of Dangerous Buildings shall be filed in
the office of the City Clerk and may be inspected
during regular business hours. Such Code is hereby
adopted in full.
Section 2. Purpose. The purpose of this Code is to provide
a just, equitable and practicable method to be cumulative with
and in addition to any other remedies provided by the Uniform
Building Code, 1985 Edition, or otherwise available at law;
whereby buildings or structures which, for any reason, endanger
life, limb, health, morals, property, safety, or general welfare
of the public or the occupants of said structures, may be
required to be repaired, vacated or demolished.
Section 3. Violation and Penalties. It shall be unlawful
for any person, firm, or corporation to wreck, construct,
enlarge, alter, repair, move, improve, remove, convert, or
demolish, equip, use, occupy, or maintain any building or
structure in the City, or cause or permit the same to be done,
contrary to, or in violation of any of the provisions of the
Uniform Building Code. Any person, firm, corporation,
partnership, or other entity, violating any of the provisions
hereof shall be subject to a fine not to exceed $999.00, or
imprisonment not to exceed 180 days, or both such fine and
imprisonment. In addition, the City may enforce the provisions
of this Uniform Code for the Abatement of Dangerous Buildings as
herein adopted by means of any of the enforcement provisions
contained therein.
Section 4. Severability. If any clause, sentence,
paragraph, or part of this ordinance or the application thereof
to any person or circumstances shall for any reason be adjudged
by a court of competent jurisdiction invalid, such judgment shall
not affect application to other persons or circumstances.
Section 5. Safety Clause. The City Council hereby finds,
determines, and declares that this ordinance is promulgated under_
the general police power of the City of Wheat Ridge, that it is
promulgated for the health, safety, and welfare of the public,
and that this ordinance is necessary for the preservation of
health and safety and for the protection of public convenience
and welfare. The City Council further determines that the
ordinance bears a rational relation to the proper legislative
object sought to be attained.
Section 6. This ordinance shall take effect one (1) day
after final publication.
INTRODUCED, READ, AND ADOPTED on first reading by a vote of
8 to 0 on this 22nd day of September , 1986,
ordered published in full in a newspaper of general circulation
in the City of Wheat Ridge and Public Hearing and consideration
on final passage set for October 13 , 1986, at
7:30 o'clock p.m., in the Council Chambers, 7500 West 29th
Avenue, Wheat Ridge, Colorado
READ, ADOPTED, AND ORDERED PUBLISHED on second and final
reading by a vote of 8 to 0 this I3th day of October
1986.
