ORDINANCE NO. 712
TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF REZONING FROM
RESIDENTIAL-TWO TO COMMERCIAL-ONE ON LAND LOCATED AT 4300
KIPLING, CITY OF WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF
COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO, THAT:
Section 1. Upon application by Charles Reed for approval of
rezoning in Wheat Ridge, Colorado, Case No. WZ-86-20, and based
upon recommendation for approval from the Wheat Ridge Planning
Commission, with conditions, and pursuant to findings made based on
testimony and evidence presented at public hearing before the Wheat
Ridge City Council, Wheat Ridge maps are hereby amended to exclude
from the Residential-Two District and to include in the
Commercial-One District, the following described land:
Beginning at a point 30 feet east of the northwest corner of the
northwest quarter of the southwest quarter of Section 22, Township
3 South, Range 69 hest of the 6th Principal Meridian, thence 58
feet south, thence 316 feet east, thence 138 feet north, thence 316
feet west, thence 30 feet south to the point of beginning. Except
that portion conveyed to the Colorado Department of Highways by
instrument recorded July 25, 1969, in Book 2120 at Page 266,
described as follows:
Beginning at a point on the south property line which is east,
along the north line of the southwest quarter of Section 22, a
distance of 45.0 feet and south, parallel with the west line of the
southwest quarter of Section 22, a distance of 58.0 feet from the
northwest corner of the southwest quarter of Section 22, Township 3
South, Range 69 West of the 6th Principal Meridian; thence West,
along the south property line, a distance of 15.0 feet to the
southwest property corner; thence north, along the west property
line, a distance 138.00 feet to the northwest property corner;
thence east, along the north property line a distance of 15.0 feet;
thence south, parallel with the west property line, a distance of
138.00 feet, more or less to the point of beginning.
Section 2. Condition. Development on the property shall be in
accordance with the Site Plan approved by City Council.
Section 3. Safety Clause. The City Council hereby finds,
determines, and declares that this ordinance is promulgated under
the general police power of the City of Wheat Ridge, that it is
promulgated for the health, safety, and welfare of the public, and
that this ordinance is necessary for the preservation of health and
safety and for the protection of public convenience and welfare.
The City Council further determines that the ordinance bears a
rational relation to the proper legislative object sought to be
attained.
Section 4. Severability. If any clause, sentence, paragraph, or
part of this ordinance or the application thereof to any person or
circumstances shall for any reason be adjudged by a court of
competent jurisdiction invalid, such judgment shall not affect,
impair or invalidate the remainder of this ordinance or its
application to other persons or circumstances.

Section 5. This ordinance shall take effect 15 days after final
publication.
INTRODUCED, READ, AND ADOPTED on first reading by a vote of
8 to 0 on this _12th- day of _January--,-_--, 1987, ordered
published in full in a newspaper of general circulation in the City
of Wheat Ridge and Public Hearing and consideration on final
passage set for _Eebruarv 9 _ = 1987, at 7:30 o'clock p.m., in
the Council Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado,
READ, ADOPTED AND ORDERED PUBLISHED on second and final reading by
a vote of 6 to -2--9 this 9th day of -Februar__---, 1987•
