Upon application by Josef and Augusta Faehnrich for approval of a public street Vacation in Wheat Ridge, Case No. WV-37-1, and udon recommendation for approval from the Wheat Ridge planning Commission, and pursuant to findings made based upon testimony and evidence presented at public hearing before the Wheat Ridge City Council, a portion of West 33rd Avenue, as legally described below, is hereby Vacated for public street right-of-way purposes: The southern 15 feet of the followin, described parcel: Beginning at the northeast corner of Deffert Subdivision, located in the northwest quarter of Section 23, T33, R69W, City of 'W'heat Ridge, County of Jefferson, State of Colorado, said point also being the northeast corner of said "35' Road Dedication"; thence 0000 1313511W on and along the east line of said subdivision a distance of 35 feet to the southeast corner of said "35' Road Dedication"; thence S89 5910511W on and along the south line of said "35' Road Dedication" a distance of 139.27 feet to the southwest corner of said dedication; thence N00 11'5511E on and along the west line of said dedication a distance of 35 feet to the northwest corner thereof; thence N89 59105"E on and along the north line of said dedication a distance of 139.28 feet, more or less, to the true point of beginning. Containing 2089 square feet, more or less Section 2. Safety Clause. The City Council hereby finds, determines, and declares that this Ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative object sought to be attained. Section 3. Severability. If any clause, sentence, paragraph, or part of this Ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect, impair or invalidate the remainder of this Ordinance or its application to other persons or circumstances. ORDINANCE 140. 717 PAGE 2 Section a. This Ordinance shall take effect _ 15 days after final publication.
