HomeMy WebLinkAboutOrdinance-1987-0719INTRODUCED BY COUNCILMEMBER WORTH Ordinance No. 719 Series of 1987 TI'T'LE: AN EMERGENCY ORDINANCE, ADOP'TE'D PURSUANT TO SECTION 5.13 OF 'THE HOME RULE CHARTER OF 'THE CITY OF WHEAT RIDGE, COLORADO, ESTABLISHING A MORATORIUM FOR A PERIOD OF NINETY DAYS FROM THE DATE HEREOF UPON ISSUANCE OF BUILDING PERMITS WITHIN THE AREA DESIGNATED AS THE WADSWORTH TOWN CENTER. WHEREAS the City Council of the City of Wheat Ridge has previously enacted Ordinance No. 488, Series of 1982, establishing the Wadsworth Town Center as an Urban Renewal Area within the City of Wheat Ridge, and has imposed plan and site review requirements as a result thereof and relating thereto; WHEREAS the Wadsworth Town Center is a vital commercial area within the City which is presently the subject of an offer to Negotiate with a Preferred Developer, which offer to negotiate may result in the execution by the City of an agreement with said developer to acquire and/or develop all property located within said Wadsworth Town Center; WHEREAS issuance of building permits, except under the provisions as specified herein, would be contrary to the orderly and profitable development of the Wadsworth Town Center. NOW THEREFORE, BE IT ORDAINED BY THE CITi COUNCIL OF THE CITY OF WHEA'T' RIDGE, COLORADO AS FOLLOWS: Section 1. An emergency exists in that requests for issuance of building permits have been made or will be made for properties within the Wadsworth Town Center, issuance of which would, in the opinion of the City Council, impede or impair the orderly development of the Wadsworth Town Center as an integrated shopping center. Section 2. There is hereby enacted, effective immediately, a moratorium upon the issuance of any building permits for any property located within the Wadsworth Town Center, except upon the following conditions: a. A finding by the Director of Planning and Development and by the Economic Development and Revitalization Commission that the permit sought will allow development consistent with the plans currently formulated by the preferred developer, or b. The property for which the permit is issued has been rezoned by the City Council during the existence of this moratorium. Section 3. This Ordinance is necessary for the immediate preservation of public property, health, and safety. Section 4. This Ordinance shall take effect upon final passage and shall be effective for ninety days from the date thereof, at which time it shall cease to be of any force or effect whatsoever. INTRODUCED, READ AND ADOPTED by a vote of 6 to 1 on this 22nd day of June, 1987, ordered published in full in a newspaper of general circulation in the City of Wheat Ridge.
