TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF AN AMENDED
OUTLINE AND FINAL DEVELOPMENT PLAN AND CHANGE OF USES
PERMITTED FOR A PLANN ED COMMERCIAL DEVELOPMENT (PCD) ZONE
DISTRICT LOCATED AT 7750 WEST 38TH AVENUE
Section 1. Upon application by William Baldry, Jr., for Congdon
Investment Company (Ownerfor approval of an amended Combined
Outline and Final Development Plan and including a change in
permitted uses, for a Planned Commercial Development District in
Wheat Ridge, Colorado, Case No. 'dZ-87-3, and based upon
recommendation for approval by the Wheat Ridge Planning Commission,
and pursuant to findings made based upon testimony and evidence
presented at public hearing, the combined Outline and Final
Development Plan and list of permitted uses for the following
described property, is hereby approved:
Tract 2 except the south 268 feet thereof, Adkins
Subdivision, County of Jefferson, State of Colorado being a
portion of the NW 1/4 of Section 26, T3S, R69W of the 6th
P.M. more particularly described as follows:
Commencing at the NW corner of the NE 1/4 of said Section
26; thence N 900 0' 0" W along the north line of said
Section 26 a distance of 660 feet; thence S 00 7' 45" W a
distance of 30 feet to a point on the south right-of-way
line of West 38th Avenue, said point also being the NW
corner of Tract 2 of said Adkins Subdivision and also being
the point of beginning; thence S 00 7' 45" W a distance of
230 feet; thence N 90o 0' 0" E a distance of 140 feet to a
point on the westerly right-of-way line of Yukon Court;
thence N 00 7' 45" E along said westerly right-of-way line
a distance of 215 feet to a point on a curve to the left
having a radius of 15 feet, a central angle of 900 7' 45"
and an arc length of 23.59 feet to a point on the south
right-of-way line of West 38th Avenue; thence N 900 0' 0" W
along said right-of-way line a distance of 125 feet to the
point of beginning.
Section 2. Safety Clause. The City Council hereby finds,
determines, and declares that this ordinance is promulgated under
the general police power of the City of Wheat Ridge, that it is
promulgated for the health, safety, and welfare of the public, and
that this ordinance is necessary for the preservation of health and
safety and for the protection of public convenience and welfare.
The City Council further determines that the ordinance bears a
rational relation to the proper legislative object sought to be
attained.

Section 3. Severability. If any clause, sentence, paragraph, or
part of this ordinance or the application thereof to any person or
circumstances shall for any reason be adjudged by a court of
competent jurisdiction invalid, such judgment shall not affect,
impair or invalidate the remainder of this ordinance or its
application to other persons or circumstances.
Section 4. This ordinance shall take effect _15-- days after final
publication.
INTRODUCED, READ, AND ADOPTED on first reading by a vote of
__8_ to _0_ on this _13th day of __July _ -9 1987, ordered
published in full in a newspaper of general circulation in the City
of dheat Ridge and Public Hearing and consideration on final
passage set for August 101987, at 7:30 o'clock p.m., in
the Council Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado.
READ, ADOPTED AND ORDERED PUBLISHED on second and final reading by
a vote of 7 to - 0 this 10th- day of AuZuu_at_--, 1987.
