HomeMy WebLinkAboutOrdinance-1988-0770INTRODUCED BY COUNCILMEMBER WORTH Ordinance No. 770 Series of 1988 TITLE: AN ORDINANCE AUTHORIZING THE CONVEYANCE OF CERTAIN REAL PROPERTY OWNED BY THE CITY, DECLARING THE PROPERTY EXCESS PROPERTY, AND APPROVING THE SPECIAL WARRANTY DEED CONVEYING SAID PROPERTY TO JOSEPH F. LOMBARDI. WHEREAS, Section 16.5 of the Home Rule Charter of the City of Wheat Ridge provides that "The City shall not sell or dispose of municipally owned buildings or real property for a public purpose without first obtaining the approval, by ordinance, of three-fourths (3/4ths) of the entire Council." WHEREAS, the City, in the preparation for and completion of improvements to West 48th Avenue/West I-70 Frontage Road North, has acquired certain real property from the Prudential Insurance Company of America; WHEREAS, approximately 0.314 acres more or less of said property constitutes real property which has been severed from the larger parcel still owned by Prudential, but is of no benefit or value to the City; WHEREAS, said real property, containing approximately 0.314 acres, more or less, is of benefit to the adjoining owner, Joseph F. Lombardi; WHEREAS, Lombardi has agreed to deed to the City, at no additional cost to City, real property for right-of-way purposes to allow the City to complete said public improvement described above; WHEREAS, the City Council has determined that the real property described herein containing approximately 0.314 acres, more or less, is excess property, and may be conveyed to Joseph F. Lombardi pursuant to the terms hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT: Section 1. The real property described in the Warrant Deed attached hereto as Exhibit A is hereby declared to be surplus and excess property of the City, and is hereby authorized and directed to be conveyed to Joseph F. Lombardi pursuant to the provisions of the attached Special Warranty Deed. Section 2. The Special Warranty Deed which is attached hereto as Exhibit A is expressly approved, the Mayor and the City Clerk are authorized to execute the same, and the same is authorized to be delivered to Joseph F. Lombardi. Section 3. Severability. If any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect application to other persons or circumstances. Section 4. Safety Clause. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative object sought to be attained. Section 5. This ordinance shall become effective one (1) day after final publication.
