HomeMy WebLinkAboutOrdinance-1988-0775INTRODUCED BY COUNCIL MEMBER DAVIS ORDINANCE NO. 75 SERIES OF 1988 TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF REZONING FROM RESIDENTIAL-TWO TO COMMERCIAL-ONE ON LAND LOCATED AT 10201 WEST I-70 FRONTAGE ROAD NORTH, CITY OF WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF COLORADO BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT: Section 1: Upon application by the City of Wheat Ridge for Prudential Insurance Company of America for approval of rezoning in Wheat Ridge, Colorado, Case No. WZ-88-13 and based upon recommendation for approval, from the Wheat Ridge Planning Commission, and pursuant to findings made based on testimony and evidence presented at a public hearing before the Wheat Ridge City Council. Wheat Ridge maps are hereby amended to exclude from the Residential-Two District and to include in the Commercial-One District, the following described land: That part of the SE 1/4 of the SE 1/4 of the SE 1/4 of Section 16, Township 3 South, Range 69 West of the 6th P.M. described as follows: Beginning at the Northwest corner of said SE 1/4 of the SE 1/4 of the SE 1/4 of said Section 16, thence South 0021' East along the West line of said SE 1/4 of the SE 1/4 of the SE 1/4, 318.98 feet, more or less, tc the Northerly line of the State Highway as described in Book 1588 at Page 508 of the Jefferson County Records, said point being the True Point of Beginning, thence North 7901'30" East along said Northerly line 260.35 feet to the Southwest corner of property described in Book 2059 at Page 787, thence North 246.97 feet and along the West line of property described in Book 2059 at page 787 to the Northwest corner thereof; thence South 89014'30" West parallel with the North line of said SE 1/4 of the SE 1/4 of the SE 1/4, 82.52 feet, more or less to the Northeast corner of property described in Book 1288 at Page 505; thence continuing south 89014'30" West, along the North line of said parcel described in Book 1288 at Page 505, 175.0 feet, more or less, to the West line of said SE 1/4 of the SE 1/4 of the SE 1/4; thence South, along said West line 298.98 feet, more or less, to said True Point of Beginning; EXCEPT the North 10 feet of the East 82.52 feet of said parcel, described in Book 1288 at Page 505 and as described in book 1897 at Page 557, County of Jefferson, State of Colorado. Section 2. Vested Property Rights. Approval of this rezoning does not create a vested property right. Vested property rights may only arise and accrue pursuant to the provisions of Section 26(c) of Appendix A of the Code of Laws of the City of Wheat Ridge. Section 3. Safety Clause. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the property legislative object sought to be attained. Section 4. Severability. If any clause, sentence, paragraph or part of this ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect, impair or invalidate the remainder of this ordinance of its application to other persons or circumstances. Section 5. This ordinance shall take effect 15 days after final publication. INTRODUCED, READ, AND ADOPTED on first reading by a vote of 8 to o on this loth day of October , 1988, ordered published in full in a newspaper of general circulation in the City of Wheat Ridge and Public Hearing and consideration on final passage set for November 14 , 1988 at 7:30 o'clock p.m., in the Council Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado.
