August 2, 1973
A Study Session of the Wheat Ridge City Council was called to order
at 7 35 p.m. at 7390 West 38 Avenue by Mayor Albert E. Anderson.
Aldermen present were Dr. Paul Abramson, Mary Jo Cavarra, Joseph
Donaldson, Robert Howard, Calvin Hulsey and Ray Pepe.
Others present were Mayor Anderson, City Clerk Louise Turner, City
Treasurer James Malone, City Attorney Maurice Fox, Staff Administrator
Walter Johnson, Recreation Superintendent Steve Pischke, Parks Director
Boyd Kraemer, Finance Officer Walter Grande and Public Works Director
Glen Taylor.
Motion by Alderman Pepe. "I move that the request for a 3.2% package
license for National Convenience Stores dba Shop N Go Markets be de-
nied because the needs of the area are being met." Motion was seconded
by Alderman Howard and the vote tied 3-3. Mayor Anderson stated he was
not prepared to vote and wanted to review the case. At a later point
he voted "nay" defeating the Motion and gave the following reasons:
the City's poll which was impartial gave 71 in favor to 14 opposed,
and 16 without an opinion which was overwhelmingly in favor, no one
had appeared in opposition and there was no opposition. He concluded
the applicant's burden had been more than legally met. The Motton was
defeated 4-3 with Aldermen Abramson, Donaldson and Hulsey voting
"nay."
Motion by Alderman Abramson "I move that a 3.2% package license for
National Convenience Stores dba Shop N Go Markets at 7700 West 38 Avenue
be granted because evidence was overwhelmingly shown that the needs of
the neighborhood are not being mat." Motion was seconded by Alderman
Donaldson and passed 4-3. Aldermen Howard, Cavarra and Pepe voted "nay."
Mayor Anderson voted "aye" to break the tie. Alderman Pepe repeated
that the needs of the neighborhood are presently being met.
MS-73-12 Minor Subdivision was brought up for decision.
Motion by Alderman Cavarra "I move that MS-73-12 be denied for the
following reasons this was the recommendation of the Planning Com-
mission and Plannlng Department and it cannot conform to the subdivision
requirements." Motion was seconded by Alderman Abramson.
Alderman Pepe said he would vote "nay" on the Motion, that one of the
planners was not opposed to it.
Motion passed 5-1. Alderman Pepe voted "nay."
Walter Kane, Lakewood City Manager spoke to the Council and answered
questions regarding the role of "City Administrator" in a statutory
City, which was set out by ordinance in Lakewood.
Steve Shikes and Robert Johnson of the U.S. Civil Service Commission
presented the classification manual of jobs and job descriptions and
answered questions. It was noted that no federal strings were attached
and that some positions were being revised.
A forester's report pertaining to Dutch Elm Disease and report on the
current recreation program were presented by Boyd Kraemer.
Preliminary Budget Report was given by Walter Grande.
In response to a request by Attorney Maurice Fox the following Motion
was made by Alderman Abramson "I move that the Treasurer be authorized
to deposit $3,000.00 in district court for use regarding condemnation
of the G. Paul Talbert property, money to come from Account No. 452.15."
Motion was seconded by Alderman Hulsey and passed 6-0.

Also on request of City Attorney Maurice Fox, a Motion was made by
Alderman Pepe "I move that we drop condBmnation procBedings on
the Charles Potuzak propBrty subject to negotiating for a trail
corridor." Motion was sBcondBd by AldBrman Abramson. It was clarified
that this would include property north of 44 Avenue which could be
purchased out of open space funds, and leased back to Mr. Potuzak for
lumber company use until the City was in a position to develop it.
Also, that an accurate legal description would be needed and would
probably cost $400 - $500." Motion passed 6-0.
Walter Grande reported that he had been in contact with Mr. Early,
an MIA expert who had indicated to him that the school distric~s
appraisal of the Wheat Ridge Junior High site was based on replacement
cost rather than market value and that there would be "considerable
discrepancy" between this and appraisal which might be done for the
City. He stated Mr. Early had set a fee of $3,000.00 to appraise
the site. Mr. Grande requested that the hiring of Mr. Early be
authorized. He added that this would be an area of expertise and
bids would not be necessary.
Mrs. Cavarra questioned whether or not there might be other appraisers
rather than specifying Mr. Early, and Mayor Anderson explained that
the City had used Mr. Early before, that the school site was involved
and included the determination of "reversionary interests" and Mr. Early
could handle the job.
Motion by Alderman Abramson "I move the Mayor be authorized to contract
with Mr Early, MIA Appraiser to secure an appraisal of the Wheat Ridge
Junior High site, at a cost not to exceed $3,000.00 without further
Council approval." Motion was seconded by Alderman Pepe.
Alderman Howard questioned appropriation of money at a study session.
Alderman Pepe withdrew the second and the Motion dies for lack of a
second.
Motion by Alderman PBpe "I move that the matter of an appraisal of
Wheat Ridge Junior High be first on the Agenda next week and this meeting
be adjourned." Motion was seconded by Alderman Abramson and passed 6-0.
Meeting was adjourned at 10 45 p.m.
