TITLE: AN ORDINANCE VACATING A PORTION OF DEDICATED WEST I-70
FRONTAGE ROAD NORTH (ALSO KNOWN AS W. 48TH AVE.), WITHIN
THE CITY OF WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF
COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT
RIDGE, COLORADO AS FOLLOWS:
Section 1: The following part of West I-70 Frontage Road
North (old W. 48th Ave.), a dedicated street in the City of Wheat
Ridge, County of Jefferson, State of Colorado, is hereby vacated,
to wit:
That part of West I-70 Frontage Road North (W. 48th Ave.) right-
of-way as dedicated on the record plat of LAKEMONT CENTER
SUBDIVISION more particularly described as follows:
BEGINNING at the Northwest corner of Lot 1, Block 2, LAKEMONT
CENTER SUBDIVISION; thence Northeasterly, along the northwest
line of said Lot 1, along a curve concave to the Northwest having
a radius of 430.00 feet and a central angle of 130 41' 42", an
arc distance of 102.78 feet to a point of tangent; thence N 410
53' 53" E (bearings based on the record plat of LAKEMONT CENTER
SUBDIVISION), continuing along the Northwest line of said Lot 1,
a distance of 90.43 feet to a point of curve; thence
Northeasterly, continuing along the Northwest line of said Lot 1,
along a curve concave to the Southeast having a radius of 350.00
feet and a central angle of 480 O1' 04", an arc distance of
293.32 feet to the South right-of-way line for West 48th Avenue
described under reception number 88066969 of Jefferson County's
records; thence Southwesterly, along said South right-of-way
line, along a curve concave to the Southeast having a radius of
307.03 feet and a central angle of 720 24' 14", an arc distance
of 387.99 feet to a point of tangent; thence S 390 09' 38" W,
continuing along said South right-of-way line, a distance of
149.77 feet to the West line of LAKEMONT CENTER SUBDIVISION;
thence S 00 05' 11" E, along the West line of LAKEMONT CENTER
SUBDIVISION, a distance of 43.48 feet to the POINT OF BEGINNING
containing 0.4539 acres more or less, TOGETHER WITH that part of
West 48th Avenue's right-of-way as dedicated on the record plat
of LAKEMONT CENTER SUBDIVISION more particularly described as
follows:
Beginning at the Southeast corner of Lot 8, Block 1, LAKEMONT
CENTER SUBDIVISION, thence S 890 54' 57" w (bearings based on the
record plat of LAKEMONT CENTER SUBDIVISION), along the South line
of said lot 8, a distance of 22.73 feet to the TRUE POINT OF
BEGINNING; thence S 890 54' 57" W, continuing along the South
Line of said Lot 8, a distance of 141.06 feet to the North right-
of-way line of West 48th Avenue described under reception number
88066969 of Jefferson County's records; thence Southeasterly,
along said North right-of-way line, along a curve concave to the
Southwest having a radius of 367.03 feet, and a central angle of
130 47' 52", an arc distance of 88.39 feet to a point of compound
curve, thence Northeasterly, continuing along said North right-
of-way line, along a curve concave to the North having a radius
of 27.00 feet and a central angle of 810 40' 33", an arc distance
of 38.49 feet to a point of tangent; thence N 410 22' 34" E,
continuing along said North right-of-way line, a distance of 7.39
feet to a point of curve; thence Northeasterly, continuing along
said North right-o£-way line, along a curve concave to the
Northwest having a radius of 220.00 feet and a central angle of
90 40' 09", an arc distance of 37.13 feet to the TRUE POINT OF
BEGINNING, containing 0.0776 acres more or less.
provided however, that any and all utility easements presently
existing in said vacated property, shall remain valid and shall
not be affected by this street vacation.
Section 2. Upon the vacation accomplished hereby, title to
the property vacated shall revert by operation of C.R.S. 1973 43-
2-302, to the abutting property owners.
Section 3. Severability. If any clause, sentence,
paragraph, or part of this ordinance or the application thereof
to any person or circumstances shall for any reason by adjudged
by a court of competent jurisdiction invalid, such judgment shall
not affect application to other persons or circumstances.
Section 4. Safety Clause. The City council hereby finds,
determines, and declares that this ordinance is promulgated under
the general police power of the City of Wheat Ridge, that it is
promulgated for the health, safety, and welfare of the public,
and that this ordinance is necessary for the preservation of
health and safety and for the protection of public convenience
and welfare. The City Council further determines that the
ordinance bears a rational relation to the proper legislative
object sought to be attained.
Section 5. This ordinance shall take effect 15 days
after final publication.

INTRODUCED, READ, AND ADOPTED on first reading by a vote of 8
to 0 on this 24th day of April , 1989, ordered published
in full in a newspaper of general circulation in the City of
Wheat Ridge and Public Hearing and consideration on final passage
set for May 22 , 1989, at 7:30 p.m., in the Council Chambers,
7500 West 29th Avenue, Wheat Ridge, Colorado.

by a, vote of 8 to 0 this 12th day of June 1989.
