HomeMy WebLinkAboutOrdinance-1989-0803INTRODUCED BY COUNCILMEMBER MERKL Ordinance No. 803 Series of 1989 TITLE: AN ORDINANCE AMENDING THE PROVISIONS OF SECTIONS 19-51(a) AND 19-52(b) OF THE CODE OF LAWS OF THE CITY OF WHEAT RIDGE DEFINING MEMBERS OF THE WHEAT RIDGE POLICE PENSION FUND AND DESIGNATING THE TRUSTEES OF THE POLICE PENSION BOARD. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT: Section 1. Section 19-51(a) of the Code of Laws of the City of Wheat Ridge is hereby repealed and reenacted as follows: (a) There is hereby established the Wheat Ridge Police Pension Fund, the purpose of which is to provide retirement benefits for members of the city police department. Members of the plan are defined as full time paid, sworn police officers of the police department of the City, and all police dispatchers hired prior to January 1, 1979. Section 2. Section 19-52(b) of the Code of Laws of the City of Wheat Ridge is hereby repealed and reenacted as follows: (b) The Police Pension Board shall serve as Trustees for the plan hereby created. The members of the Police Pension Board shall be the Mayor, the City Treasurer, the City Clerk, the Chief of Police, and two members of the plan as defined herein, which members of the plan shall be elected by the membership of the plan. One such plan member shall be elected annually for a two (2) year term, so that the two elected Board members serve staggered terms as Trustees. The Trustees shall receive no pay for services as members of the Board." Section 3. Safety Clause. The City council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the property legislative object sought to be attained. Section 4. This ordinance shall become effective 1 day after final publication. INTRODUCED, READ, AND ADOPTED on first reading by a vote of 8 to 0 on this 24th day of July , 1989, ordered published in full in a newspaper of general circulation in the City of Wheat Ridge and Public Hearing and consideration on final passage set for August 14 1989, at 7:30 o'clock p.m., in the Council Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado.
