HomeMy WebLinkAboutOrdinance-1989-0810INTRODUCED BY COUNCILMEMBER SNOW Ordinance No. 810 Series of 1989 TITLE: AN ORDINANCE AMENDING SECTION 13-2, MODEL TRAFFIC CODE OF THE CODE OF LAWS OF THE CITY OF WHEAT RIDGE BY DESIGNATING THE DIRECTOR OF PUBLIC WORKS, OR HIS DESIGNEE, AS THE "TRAFFIC ENGINEER" FOR PURPOSES OF TRAFFIC ADMINISTRATION OF THE PROVISIONS OF THE MODEL TRAFFIC CODE, AND FURTHER RESERVING TO THE CITY COUNCIL THE AUTHORITY TO REVIEW AND ESTABLISH SPEED ZONES AND SPEED LIMITS ON LOCAL STREETS. WHEREAS the City of Wheat Ridge has adopted the "Model Traffic Code for Colorado Municipalities, 1977 Edition," as a portion of the Code of Laws of the City of Wheat Ridge; WHEREAS said Model Traffic Code (MTC) authorizes the establishment of speed zones by the "Traffic Engineer" of the City; WHEREAS the Model Traffic Code, in its present state, designates the Chief of Police as the "Traffic Engineer" in the absence of any specific appointment by the City of an individual or entity as the "Traffic Engineer"; WHEREAS the City Council of the City of Wheat Ridge wishes to appoint the Director of Public Works, or his designee, as the "Traffic Engineer" for purposes of administration of the provisions of the MTC within the boundaries of the City of Wheat Ridge, and further wishes to reserve unto itself, as the legislative body of the City, the power and authority to review and enact speed zones in certain circumstances and upon certain streets within the City. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT: Section 1. Pursuant to the provisions of Section 23-8 of the Model Traffic Code for Colorado Municipalities, the City Council of the City of Wheat Ridge does hereby designate and appoint the Director of Public Works, or his designee, as the "Traffic Engineer" as said office is created and described in said Model Traffic Code, and does further hereby authorize and empower the Director of Public Works, or his designee, to have and to exercise all powers and duties assigned to the "Traffic Engineer" by the within the Model Traffic Code. Section 2. The Code of Laws of the City of Wheat Ridge is hereby amended by adding the following provision to Section 13-2(b) of said Code of Laws: 1123-9. Section 23-9. Duties and Powers of Traffic Engineer or other designed traffic official, of the Model Traffic code, is hereby amended by the addition of the following Section 23- 9(c): (c) The City Council of the City of Wheat Ridge hereby reserves unto itself the specific power and authority to review and approve or modify the designation of speed zones and the establishment of speed limits on streets which are not state highways or streets maintained by the state or county (hereinafter local streets). The Traffic Engineer shall forward copies of all speed zoning studies and designation of speed limits to the City Council for it's review. Said speed limits, as established by the Traffic Engineer, shall be lawful and in effect unless and until the same are modified or amended by a motion adopted by a majority of the entire City Council. In considering the amendment of any such speed limit as established by the Traffic Engineer, the City Council shall consider all speed zoning studies conducted by the Traffic Engineer, all of the criterion specified in Section (a) of this Section 23-9, and shall consider pedestrian safety, site distance, and neighborhood safety considerations in addition thereto." Section 3. Severability. If any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect application to other persons or circumstances. Section 4. Safety Clause. The city council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the property legislative object sought to be attained. Section 5. This ordinance shall become effective immediately. INTRODUCED, READ, AND ADOPTED on first reading by a vote of 6 to 2 on this 25th day of September , 1989, ordered published in full in a newspaper of general circulation in the City of Wheat Ridge and Public Hearing and consideration on final passage set for October 9, , 1989, at 7:30 o'clock p.m., in the Council Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado. 2 READ, ADOPTED, AND reading by a vote of 6 October 1989.
