September 6, 1973
September Study Session of the Wheat Ridge City Council was called
to order at 7 40 p m. at 7390 West 38 Avenue by Mayor Albert E. Anderson.
Aldermen attending were Dr. Paul Abramson, Mary Jo Cavarra, Joseph
Donaldson, Robert Howard, Calvin Hulsey and Ray Pepe.
Also attending were Mayor Albert Anderson, City Clerk Louise Turner,
City Treasurer James Malone, City Attorney Maurice Fox, Staff Administrator
Walter Johnson, Purchasing Agent Walter Grande, Police Chief Ed Pinson,
Public Works Director Glen Taylor, and interested citizens.
WZ-73-12 Rezoning Case came up for decision.
In answer to questions from Aldermen Howard, Pepe and Donaldson, City
Attorney Maurice Fox stated that a figure given on the application as
129,000 square feet was actually 117,000 square feet, that there was
no illegality and this had no bearing on the rezoning request, that
there was adequate land supporting the high rise and no danger of rendering
that structure non-conforming.
Motion by Alderman Howard "I move that Case No. WZ-73-12 request by the
United Presbyterian Association for a change from Residential-Two and
Residential-Three to Residential-Three-A, be denied for the following
reasons 1. It does not conform to the Land Use Plan. 2. The Planning
Commission recommended denial. 3. There was strong neighborhood opposition."
Motion was seconded by Alderman Hulsey.
Alderman Hulsey stated the facility was needed, but a guarantee was needed
as to use, that if the property sold, new owners would not be bound to
commitment, that he couldn't vote for Residential-Three-A zoning, and felt
Hospital-One or Planned-Development would have been more appropriate.
Alderman Cavarra stated she agreed with Alderman Hulsey that the Hospital-
One or Planned-Development categories would better protect both the ap-
plicants and the opponents.
Alderman Pepe stated he approved of the concept and that the City should
pursue a covenant and also assist them in getting the Health Department
Certificate.
Alderman Abramson suggested it be approved subject to certain conditions.
City Attorney Fox stated "rezoning subject to something would not be proper,
that other zone classifications existed which would allow the desired use,
and since they are different from the present request a denial would allow
the applicant to reapply without having to wait.
Alderman Donaldson stated he would vote for the Motion because there are
too many uses allowed under Residential-Three-A.
Question was called on the Motion, and Motion passed 4-2. Alderman Pepe
and Alderman Abramson voted "nay."
Items brought up for discussion were
1 Use Tax Ordinance by Walter Grande to be on the September 13, 1973
Agenda for final reading and City Clerk to notify the Chamber of Commerce.
2. Removal of a sanitary sewer at Marshall Street Bridge by Glen
Taylor to be on September 13, 1973 Agenda.
3. Authorization of a consulting engineer for Public Works by
Glen Taylor to be tabled one week and considered at a public meeting.
4. Holding hearings at all meetings by Alderman Abramson was ruled
out of order to be on October 4, 1973 Agenda.
5. Harlan Street Master Drainage Plan by Glen Taylor to be on
September 20, 1973 Agenda.

6. Affirmative action policy, Pay Ordinance and Classification
Manual by Walter Johnson, all to be on the September 20, 1973 Agenda.
7. Street Cut Ordinance by Attorney Fox to be re-written or amended.
Penal Code is to be updated by City Attorney Fox.
8. Budget for 1974 by Walter Grande with a Public Hearing to be
held September 27, 1973 and notice to be given.
9. Bond Issue by Alderman Pepe. City Attorney Fox was asked
to bring information as to procedure to placing it on the ballot.
10. 38 Avenue compromise by Alderman Cavarra was ruled out of order
11. Ordinance for position of city administrator by Alderman Howard
to be on September 13, 1973 Agenda.
Meeting was adjourned at 11 DO p.m. for an executive session
