HomeMy WebLinkAboutOrdinance-1990-0827 INTRODUCED BY COUNCILMEMBER MERKL Ordinance No. 827 Series of 1990 TITLE: AN ORDINANCE ADOPTING ALL OF THE PROVISIONS OF CHAPTER 26, ZONING AND DEVELOPMENT, OF THE CODE OF THE LAWS OF THE CITY OF WHEAT RIDGE, ASSIGNING SECTION NUMBERS TO EACH SECTION THEREOF, AND ORDERING ALL PROVISIONS CITED HEREIN TO BE CODIFIED. WHEREAS, the City Council of the City of Wheat Ridge has authorized the creation and appointment of a Land Development Regulations Task Force whose purpose and function has been to review the entire Zoning Ordinance of the City of Wheat Ridge, as well as all other land development regulations, and to report to the Planning Commission and City Council their recommendation for changes thereto; WHEREAS, upon receipt of the recommendations from said Land Development Regulations Task Force, the Planning commission and city Council have considered the same and have acted thereon; WHEREAS, based upon the recommendations of the Land Development Regulations Task Force and the Planning commission, and after public hearings and deliberations, the City Council of the city of Wheat Ridge has adopted various ordinances, thereby adopting a new zoning code and related land development regulations for the City of Wheat Ridge; WHEREAS, the City Council of the city of Wheat Ridge wishes to have all of said ordinances and regulations codified in the Code of Laws of the city of Wheat Ridge in a logical, organized manner as presented herein. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT: Section 1. Adoption of Index and Orqanization for Cha~ter 26. SUBDIVISION REGULATIONS (The Subdivision Regulations currently in place shall remain unaffected, having been adopted as Ordinance No. 672, Series of 1986. Upon readoption, the same shall be codified.) ARTICLE IV. SIGN CODE (The Sign Code currently in place shall remain unaffected, having been adopted as Ordinance No. 225, Series of 1976 as amended. Upon readoption, the same shall be codified.) ARTICLE V. Statement of Limitation and Intent. In adopting this ordinance, the sole intent of the city council is to codify, and renumber without change or amendment from the original adopting ordinance, the provisions herein codified. In the event of any change or discrepancy between the provisions as codified and as originally adopted, the provisions as originally adopted shall supercede and prevail. It is further the intent of the City council in the adoption of this ordinance to change only the legislative provisions of the City's zoning and development regulations, and not to change the underlying zoning on any individual properties. Section 3. Severabil i tv. I f any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect application to other persons or circumstances. 4 Section 4. Safety Clause. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the property legislative object sought to be attained. section 5. This ordinance shall become effective 1 day after final publication. INTRODUCED, READ, AND ADOPTED on first reading by a vote of 8 to 0 on this 12th day of March , 1990, ordered published in full in a newspaper of general circulation in the City of Wheat Ridge and Public Hearing and consideration on final passage set for April 9 , 1990, at 7:30 o'clock p.m., in the Council Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado.
