TITLE:
AN ORDINANCE REPEALING SECTION 8-1 AND REENACTING
SECTION 8-1 OF THE CODE OF LAWS OF THE CITY OF WHEAT
RIDGE, ADOPTING BY REFERENCE THE UNIFORM FIRE CODE,
1988 EDITION, COPYRIGHT 1988, PROVIDING FOR CERTAIN
AMENDMENTS THERETO, AND PROVIDING PENALTIES FOR
VIOLATION THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO:
Section 1. Section 8-1 of the Code of Laws of the City of Wheat
Ridge is hereby repealed and reenacted as follows:
The Uniform Fire Code, 1988 edition, copyright 1988, by
the International Conference of Building Officials, and the
Western Fire Chiefs Association, is hereby adopted by reference
and incorporated into this article as though fully set forth
herein as the Fire Code of the City of Wheat Ridge. Three (3)
copies of said Uniform Fire Code shall be filed in the office of
the City Clerk and may be inspected during regular business
hours. Except as otherwise provided hereafter, such Code is
adopted in full, including the outline of contents, index and
appendixes: I-A, I-B, I-C, II-A, II-B, III-A, IV-A, VI-A, VI-B
and VI-D contained therein.
Section 2. Section 8-5 of the Code of Laws of the City of Wheat
Ridge is hereby repealed and reenacted as follows:
"Section 8-5. Amendments. The "Uniform Fire Code" 1988
edition, adopted by Section 8-1 hereof is hereby amended
as follows (section numbers referred to herein refer to
and correspond with the section numbers of the Uniform
Fire Code):
(a) Section 2.101 shall be amended by deleting the
first paragraph in its entirety and substituting the
following:
The Uniform Fire Code shall be enforced by the Chief
Building Inspector of the City of Wheat Ridge and his
designated assistants, who shall perform the following
functions:

In addition, the Uniform Fire Code shall be
enforced by the Bureaus of Fire Prevention of the
Wheat Ridge Fire Protection District, the Arvada
Fire Protection District, the Lakewood Fire
Protection District and the Fairmont Fire
Protection District, for the functions as listed in
Section 2.101.
(b) Section 2.303. Board of Appeals, shall be deleted
and in its place the following sentences shall be added:
"In order to determine the sui tabili ty of alternate
materials and type of construction, and provide
reasonable interpretation of the provisions of this
Code, the Building Code Advisory Committee, previously
established by Chapter 2 of the Code of Ordinances of
the City shall have authority to hear and decide those
matters delegated to it, and all matters requiring use
of a board of appeals by this Fire Code."
(c) Article 4 , Permits. Sections 4.101 through 4.108
shall be deleted in their entirety.
( d) Section 10.207 ( a) . General, shall be amended by
adding a second sentence to Section 10.207 (a) to read:
It shall be the responsibility of the owner, tenant,
manager or any agent of the owner to maintain the
requirements of this section.
(e) Section 10.208(a) General. Premises Identification
shall be amended by adding to the last sentence the
words, "and shall be a minimum of 4 inches in height."
(f) Section 10.209. Key Box shall be amended by adding
subsection (b) "All buildings with a required fire alarm
system or automatic fire-extinguishing system installed
shall be required to provide a key box in a location
approved by the respective Fire District."
(g) Section 10.301 (c). Water Supply the first para-
graph shall be amended to read, "An approved water
supply capable of supplying the required fire flow for
fire protection shall be provided to all premises upon

which buildings or portions of buildings are hereafter
constructed. A fire hydrant shall be installed and
maintained within 150 feet of a fire department
connection serving a sprinkler or standpipe system.
(h) Section 10.301 ( f) . Approval and Testing shall be
amended by adding a second paragraph which shall read,
"When the control unit or annunciator of a fire alarm
system, or the main valve of an automatic fire extin-
guishing system or standpipe system are installed in a
separate room, the door to the room shall be
appropriately marked."
(i) Section 10.305(b). Approvals shall be amended by
addition of the following:
"Fire department hose connections for sprinkler and
standpipe systems shall be located a minimum of 36
inches, and a maximum of 48 inches, above the adjacent
finished grade.
When an automatic fire-extinguishing system or standpipe
system is provided in a building and it serves more than
one tenant space, the main control valve shall be
located within a room that has access provided from the
building exterior with a door for fire department
access. Said door shall be a 3' 0" by 6' 8" minimum
dimension and shall be appropriately labeled with a
permanent sign with letters not less than 3/4 inch wide
and at least 6 inches tall."
(j) Section 10.306(a). Where Required shall be amended
by adding a new paragraph which shall read as follows:
"Audible fire alarm signals shall be installed wi thin
any building containing a sprinkler system.
(k) Section 10.3l3(e). Operation and Maintenance,
shall be amended by the addition of a sentence to the
last paragraph, which shall read, "The control unit for
the fire extinguishing system shall be electrically
supervised by the fire alarm system when the building is
required to have an alarm system installed."

approved by the Air Pollution Control District having
jurisdiction, and any other such fire shall be
prohibi ted. Fires builtin fireplaces used for non-
commercial or recreational purposes, fires necessary for
agricultural operations, irrigation ditch maintenance
fires used for fire department training purposes shall
be exempt from these regulations if an appropriate air
pollution permit has been obtained and if such fires are
not hazardous in the opinion of the Fire Chief."
(m) Section l2.l04(e). Door Identification shall be
amended by adding the following paragraph:
"Exit doors that could be obstructed from the outside
shall be posted with a permanent sign on the exterior
side of the door stating, "EXIT-DO NOT BLOCK". This
sign shall consist of letters not less than 3/4 inches
wide and at least 6 inches high on a contrasting back-
ground.
(n) Section l4.l03(b). System Design.

(p) Section 14.105. Special Provisions

devices shall be provided on all required duct
detectors, elevator and electrical panel rooms and
where detection device actuation is not readily
visible to responding fire fighters.
(e) Duct Detection Systems. A building containing
a fire alarm system and having required duct
detectors shall have the duct detection system tied
into the fire alarm system on a separate zone.
(q) Section 14.107. Automatic Telephone Dialing
Devices, shall be amended by adding the following
sentence:

"Automatic telephone dialing devices shall not be
installed on fire alarm systems, detection systems, or
sprinkler systems required by this code."
(r) Section 45.203(a).

(s) Section 79.903(b). Supervision, shall be amended
by deletion of the EXCEPTION.
(t) Section 79.1204 (b) . Leaving Vehicle Unattended,
shall be amended to read as follows:
"The driver, operator or attendant of any tank vehicle
shall not leave the vehicle while it is being filled or
discharged. Delivery and/or Vapor Recovery hoses when
attached to a tank vehicle shall be considered part of
the tank vehicle.
It shall be unlawful for any driver, operator or
attendant to defeat or fail to use any vapor recovery
device or system that has been provided for vapor
recovery purposes. All equipment shall be approved for
use with the vapor recovery system provided at the
site. "
(u) Sec. 85.108. Access shall be amended by adding the
following paragraph:
"Electrical rooms containing the main electric dis-
connect switch shall be identified with a permanently
affixed sign that reads "Main Electric Disconnect."
This sign shall be affixed to the outside of the door
leading to the room.
Section 3. Purpose. The purpose of this Code is to provide
minimum standards to safeguard life and limb, health, property,
and public welfare by regulating and controlling the design,
construction, quality of materials, use and occupancy, location
and maintenance of all buildings and structures within the City
and certain equipment specifically regulated herein.
Section 4. Violation and Penalties. Any person, firm,
association or other entity doing any act of omission in
violation of this Code shall be subject to prosecution, and
subsequent penalty, if any, as provided in Section 5-5 of the
Code of Laws of the City of Wheat Ridge.

Section 5. Severabilitv. If any part or parts of this ordinance
are for any reason held to be invalid, such decision shall not
affect the validity of the remaining portions of this ordinance.
The City Council hereby declares that it would have passed this
ordinance and each part or parts thereof, irrespective of the
fact that anyone part or parts be declared invalid.
Section 6. Safety Clause. The City Council hereby finds,
determines, and declares that this ordinance is promulgated under
the police power of the City of wheat Ridge; that it is
promulgated for the health, safety, and welfare of the public,
and that this ordinance is necessary for the preservation of
heal th and safety for the protection of public convenience and
welfare. The City Council further determines that the ordinance
bears a rational relation to these objectives.
Section 7. This ordinance shall take effect 15 days after final
publication.

consideration on final passage set for July 9
