HomeMy WebLinkAboutOrdinance-1990-0836 INTRODUCED BY COUNCIL MEMBER DAVIS ORDINANCE NO. 836 Series of 1990 TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF A SPECIAL USE PERMIT TO ALLOW A BED AND BREAKFAST IN A RESIDENTIAL-TWO ZONE DISTRICT ON PROPERTY LOCATED AT 3270 ALLISON ST., CITY OF WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF COLORADO. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT: Section 1: Upon application by Jack Bailey for approval of a Special Use Permit in Wheat Ridge, Colorado, Case No. SUP-90-2, and based upon a recommendation for approval from the Wheat Ridge Planning Commission and pursuant to findings made based on testimony and evidence presented at a public hearing before the Wheat Ridge City Council, a Special Use Permit to allow a Bed and Breakfast in the Residential-Two zone district is hereby approved for the following described land: THAT PART OF THE SOUTHWEST QUARTER OF THE SOUTHEAST QUARTER OF THE NORTHWEST QUARTER OF SECTION 26, TOWNSHIP 3 SOUTH, RANGE 69 WEST OF THE SIXTH PRINCIPAL MERIDIAN, IN THE CITY OF WHEAT RIDGE, IN JEFFERSON COUNTY, COLORADO, DESCRIBED AS: BpGINNING ON THE WEST LINE OF THE SOUTHEAST QUARTER OF THE NORTHWEST QUARTER OF SAID SECTION 26, ON THE EAST RIGHT-OF-WAY LINE OF ALLISON STREET, 395.0 FEET NORTH OF THE SOUTHWEST CORNER OF SAID SOUTHEAST QUARTER OF THE NORTHWEST QUARTER; THENCE EAST, PARALLEL WITH THE EAST-WEST CENTERLINE OF SAID SECTION 145.3 FEET; THENCE SOUTH PERPENDICULAR TO SAID EAST-WEST CENTERLINE 197.4 FEET; THENCE WEST, PARALLEL WITH SAID EAST-WEST CENTERLINE, 145.46 FEET, MORE OR LESS, TO THE WEST LINE OF THE SOUTHEAST QUARTER OF THE NORTHWEST QUARTER ON THE EAST RIGHT-OF-WAY LINE OF ALLISON STREET; THENCE NORTH, ALONG SAID EAST RIGHT-OF-WAY LINE, 197.4 FEET, MORE OR LESS, TO THE POINT OF BEGINNING. Section 2. Condition. a) That signage would be prohibited. b) That only the two bedrooms on the second floor of the owner's residence shall be used for the Bed and Breakfast and only one (1) family may occupy such bedrooms. Section 3. Vested Property Rights. Approval of this Special Use Permit does not create a vested property right. Vested property rights may only arise and accrue pursuant to the provisions of Section 26(c) of Appendix A of the Code of Laws of the City of Wheat Ridge. Section 4. Safety Clause. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative object sought to be attained. Section 5. Severability. If any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect, impair or invalidate the remainder of this ordinance or its application to other persons or circumstances. Section 6. This ordinance shall take effect final publication. 15 days after INTRODUCED, READ, AND ADOPTED on first ready by a vote of ~ to ~ on this 11th day of June , 1990, ordered published in full in a newspaper of general circulation in the City of Wheat Ridge and Public Hearing and consideration on final passage set for July 9 , 1990, at 7:30 o'clock p.m., in the Council Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado.
