TITLE:
AN ORDINANCE AMENDING THE PROVISIONS OF SECTION 22-76 OF
THE CODE OF LAWS OF THE CITY OF WHEAT RIDGE BY AMENDING
THE THRESHOLD OF SALES TAXES REQUIRED TO BE GENERATED IN
ORDER TO PARTICIPATE IN THE ESTIP PROGRAM.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO, THAT:
Section 1. section 22-76 of the Code of Laws of the City of
Wheat Ridge is hereby repealed and reenacted as follows:
Sec. 22-76. Participation.
participation in ESTIP shall be based upon approval by the
city council exercising its legislative discretion in good faith.
Any owner or proprietor of a newly established or proposed retail
sales tax generating business or location, or the owner or
proprietor of an existing retail sales tax generating business or
location which wishes to expand substantially, may apply to the
city for inclusion within the ESTIP provided that the new or
expanded business is reasonably likely to generate enhanced sales
taxes of at least t~~tlt.yt.~9H$gtJ.9ig9+::+;1,t#~I.J$~Q;qPQ~qPT FIVE
THOUSAND DOLLARS ($5,000.00) in the first year of operation.
Section 2. Severability. If any clause, sentence, paragraph,
or part of this ordinance or the application thereof to any person
or circumstances shall for any reason be adjudged by a court of
competent jurisdiction invalid, such judgment shall not affect
application to other persons or circumstances.
Section 3. Safety Clause. The City Council hereby finds,
determines, and declares that this ordinance is promulgated under
the general police power of the City of Wheat Ridge, that it is
promulgated for the health, safety, and welfare of the public, and
that this ordinance is necessary for the preservation of health and
safety and for the protection of public convenience and welfare.
The City Council further determines that the ordinance bears a
rational relation to the property legislative object sought to be
attained.
Section 4. This ordinance shall become effective 15 day(s)
after final publication.

7 to 0 on this 22nd day of October , 1990,
ordered published in full in a newspaper of general circulation in
the city of Wheat Ridge and Public Hearing and consideration on
final passage set for Monay, November 26
