October 4, 1973
The October Study Session of the Wheat Ridge City Council was called
to order at 7 40 P m. at 7390 West 38 Avenue by Mayor Albert E Anderson.
Aldermen attending were Dr. Paul Abramson, Mary Jo Cavarra, Joseph
Donaldson, Robert Howard and Ray Pepe Alderman Calvin Hulsey arrived later.
Others attending were Mayor Anderson, City Clerk Louise Turner, ity
Treasurer James Malone, Walter Grande Finance Officer, Jack Prose Chief
Building Inspector, Glen Taylor Director of Public Works, Walter Johnson
Staff Administrator, Steve Pischke Recreation Superintendent, Ed Pinso~
Chief of Police, representatives from the Chamber of Commerce Ordinance
Committee and other interested citizens. City Attorney Fox was also present.
Rezoninq Case WZ-73-24 came up for decision.
Motion by Alderman Cavarra "I move that Case WZ-73-24 (application of
Dr. Weldon T Heard at 11700 West 38 Avenue for a change from Residential-
One to Residential-one-A) be denied for these reasons
1. The present zoning allows for adequate use of the land.
2 There was considerable opposition presented at the hearing.
3. There was a recommendation of denial from the Planning Commission
and the Planning Department." Motion was seconded by Alderman Abramson
and passed 5-1. Alderman Howard voted "nay" Alderman Hulsey's vote
opposing the rezoning of the property in question was read by Mayor Anderson
and is attached to the Minutes.
The Denver Reqional Council of Governments Housing Plan for the Denver
Metro area was given by Larry Borgen of COG. He stated
1 The plan was a "fair share" plan adopted by DRCOG in December 1972
allowing for an equalized distribution of low and moderate income housing
throughout the metro area
2 That Wheat Ridge had 2 4% of the area population.
2.4% of the total housing
2 2% of the fair share allocation
3 That Wheat Ridge needed to be responsible for 238 units of low
cost and 341 unit of moderate incomes
4. Often the regulations imposed by municipal governments raised
the prices so as to be impossible to build low and moderate income units
5 74% of the jurisdiction in the area had approved the plan.
The shorter version of the plan is filed under "DRCOG - Housing" in the
General File
A report of the Chamber of Commerce Ordinance Committee was given by Kenneth
Alley. Among other things, he stated problems are beginning to surface as
a result of the passing of the City's Subdivision Regulations, and Ordinances
No 98, No 130 and No. 131 Specific reference was made to
1. The unrealistic application of the Subdivision Regulations to single
lot owners and established business areas They asked outright repeal of
Ordinance no. 130.
2 The hardship placed on contractors and consequently the penal-
ization of homeowners and businesses because of escrow requirements of
Ordinance No. 131 and also the requirement of dedication of water and sewer
lines to the City
3. Setback requirements of Ordinance No. 98, an amendment was
recommended in the written report and it was suggested that existing stan-
dards be utilized as a criterion.
4. The procedures that resulted in 3 to 4 week delays in the issuance
of building permits
Comments by Mr Allev and Frank Callahan and Ed Sutton indicated there
should be professional expertise in departments to handle requirements
so that neither the present Mayor nor future mayors should have the summer
backlog which resulted this year from the Mayor's having to check out all
permit applications before approving them.

The written report which was read is attached to the Minutes and filed
in the General File under "Ordinance Committee - Chamber of Commerce."
There are also cross reference notes in Ordinance No. 98, escrow funds
and subdivision regulations - general.
Alderman Pepe requested that an Ordinance repealing Ordinance No. 130
be put on the octover 11, 1973 Agenda
Walter Grande, Finance Officer presented for discussion the purchase of
additional vehicles for use by the Police Department Burglary Tactical
Unit, and also 2 snow plows for Public Works, and also it was noted that
Council had received written information on the following 5 portable
radios with bids by Motorola at $1,229 00 each and by RCA at $1,136 00 each;
additional premiums due on the Police and Public Works "Special Multi-
Peril Policy Insurance" in the amount of $1,754.00, barricades, natural
gas and sewer lines for the Parks Building at 4350 Garrison.
Resolution No 247 changing the amount of the unallocated surplus was
introduced by Alderman Donaldson and read.
Motion by Alderman Pepe "I move that Resolution No. 247, introduced by
Alderman Donaldson be adopted." Motion was seconded by Alderman Howard.
Alderman Hulsey stated he would vote in favor Alderman Howard stated
he would vote against the Resolution because such action should be done
at a regular meeting, not a study session Motion passed 5-1. Alderman
Howard voted "nay "
Police Chief Ed Pinson stated that fees at the County Pound had been
increased to $10.00 for the first day and $1.50 for each succeeding day
and the animal ordinance should be changed to allow payment of this
increase.
Mavor Anderson related that negotiations for a tri-city pound had been
underway prior to the firing of Arvada's City Manager.
Alderman Abramson stated that the increase of $125.00 per month based on
Chief Pinson's figures of 22-25 animals per month impounded did not warrant
the building of a multi-thousand dollar pound.
Alderman Howard stted cities in Adams County do not pay to use the pound
and Wheat Ridge should check into the procedure in Adams County.
City Attornev Fox stated that he had prepared a relinquishment agreement
which was intended to decline by the City ownership of utility lines
which wording in the subdivision regulations indicated was required by
the City. The agreement was read and action is to be taken on October 11, 1973.
A proposal from the Denver Board of Water Commissioners to run a 72 inch line
through Wheat Ridge was discussed. The matter will be acted upon October 18,
1973. Alderman Donaldson stated street paving necessitated by this water
line should be provided by the Denver Water Board. Ralph Johnson said
Wheat Ridge Water District would receive additional taps from Denver because
of it
Alderman Abramson asked that the Sentinel Newspaper publish the fact that
people might apply to fill the vacancy on the Planning Commission created
by the resignation of Eileen Pryor Moss.
Backlog of zoning cases was discussed and it was determined that the present
backlog did not warrant the scheduling of hearings other than the second
and fourth meetings, but that perhaps this should again be considered prior
to the summer rush
Mavor Anderson stated that a letter had come from Arvada Fire District in-
dicating court action if the ambulance operated by the Wheat Ridge Fire
District continued to go into the Arvada area

Mavor Anderson stated that a request for inclusion of a recently annexed
area in the Northwest Lakewood Sanitation District had been refused and
a request had come to the City for service He added it was becoming
difficult to solve problems with the districts because of a lack of
communication and cooperation and a fear the districts have that the
City wants to take them over
City Attornev Fox said he was willing to work out a street cut ordinance
which would be acceptable to the districts and the City because both were
interested in providing service to the people
Motion by Alderman Hulsey "I move that City Attorney Fox meet with the
districts and work out a solution to the stre8t cut permits and bring back
the results to th8 Council for approval." Motion was seconded by Alderman
Abramson and passed 6-0.
It was determined that the meeting of November 22, 1973 would be held on
the 20th of November, that the Classification Manual would be scheduled
for October 18, 1973 and the Ordinance for the pay of the City Clerk and
City Treasur8r, since nomination petitions have to be fil8d by October 12,
1973, would be heard on first reading on October 11, 1973
