TITLE: AN ORDINANCE VACATING A PORTION OF WEST 33RD AVENUE NORTH
OF 3285 BALSAM STREET (CASE NO. WV-9l-3) WITHIN THE CITY
OF WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF COLORADO.
WHEREAS, a certain street known as West 33rd Avenue was dedicated
to the public as part of Bebber Subdivision; and
WHEREAS, that portion of said dedicated West 33rd Avenue is no \/~
longer necessary for use by the public; and
WHEREAS, said part of said West 33rd Avenue lies within the City
of Wheat Ridge, County of Jsfferson, State of Colorado; and
WHEREAS, no land would, by a vacation of a part of said street,
be left without an established public road connecting it with another
established public road; and
WHEREAS, the Wheat Ridge Planning Commission has recommended
approval of the vacation of said part of said street;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO AS FOLLOWS:
Section 1. The following portion of West 33rd Avenue, a
dedicated street within the City of Wheat Ridge, County of Jefferson,
State of Colorado, is hereby vacated, to wit:
A portion of Bebber Subdivision located in the southwest l/4 of
the northwest 1/4 of Section 26, Township 3 South, Range 69
West, of the 6th Principal Meridian, County of Jefferson, State
of Colorado, more particularly described as follows;
The north 25 feet of the west 125 feet of property described as
follows: Beginning at the North line of West 32nd Avenue, 4l7.4
feet East and 30 feet North of the West quarter corner of
section 26, Township 3 South, Range 69 West of the Sixth
Principal Meridian, thence North and parallel with the section
line 417.4 feet; thence East and parallel with the East-West
section center line 596.4 feet; thence South and parallel with
the section line 25.0 feet; thence West and parallel with the
East-West section center line 306.4 feet; thence South and
parallel with the section line 392.4 feet to the North line of
West 32nd Avenue; thence West along said line 290.0 feet to the
point of beginning.
Section 2. Upon the vacation accomplished hereby, title to the
property vacated shall revert by operation of C.R.S. 1973, 43-2-02 to
the owner of record of Lot 5. Bebber Subdivision.
Section 3. Safety Clause. The City Council hereby finds, determines,
and declares that this ordinance is promulgated under the general
police power of the City of Wheat Ridge, that it is promulgated for
the health, safety, and welfare of the public, and that this Ordinance

is necessary for the preservation of health and safety and for the
protection of public convenience and welfare. The City Council
further determines that the ordinance bears a rational relation to the
proper legislative object sought to be attained.
Section 4. Severabilitv. If any clause, sentence. paragraph, or part
of this Ordinance or the application thereof to any person or ~_
circumstances shall for any reason be adjudged by a court of competent or
jurisdiction invalid, such judgment shall not affect, impair or
invalidate the remainder of this ordinance or its application to other
persons or circumstances.
Section 5. This Ordinance shall take effect one day after final
publication.
INTRODUCED, READ, AND ADOPTED on first ready by a vote of 8 to 0
on this 12th day of August , 1991, ordered published in full
in a newspaper of general circulation in the City of Wheat Ridge and
Public Hearing and consideration on final passage set for Monday,
September 9 , 1991, at 7:30 o'clock p.m., in the Council Chambers,
7500 West 29th Avenue, Wheat Ridge, Colorado.
READ, ADOPTED AND ORDERED PUBLISHED on second and final reading by a
vote of 8 to 0, this 9th day of September , 1991.
