TITLE:
AN ORDINANCE VACATING A PORTION OF GARRISON STREET NORTH
OF WEST 35TH AVENUE (CASE NO. WV-91-20 WITHIN THE CITY
OF WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF COLORADO.

WHEREAS, a certain street known as Garrison Street was
dedicated to the public; and
WHEREAS, that portion of said dedicated Garrison Street is no
longer necessary for use by the public; and
WHEREAS, said part of said Garrison Street lies within the
city of Wheat Ridge, County of Jefferson, State of Colorado; and
WHEREAS, no land would, by a vacation of a part of said
street, be left without an established public road connecting it
with another established public road; and
WHEREAS, the Wheat Ridge Planning Commission has recommended
approval of the vacation of said part of said street;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WHEAT RIDGE, COLORADO, AS FOLLOWS:
Section 1. The following portion of Garrison Street, a
dedicated street within the City of Wheat Ridge, County of
Jefferson, State of Colorado, is hereby vacated, to wit:
A parcel of land in the north 1/2 of section
27, Township 3 South, Range 69 West of the 6th
Principal Meridian, City of Wheat Ridge, County
of Jefferson, State of Colorado, more
particularly described as follows:
Commenc ing at the north l/ 4 corner of sa id
Section 27; thence southerly 1027.6 feet, more
or less, along the west line of the northeast
1/4 of said section 27; thence easterly 20 feet
to the southwest corner of Garrison Gardens
Subdivision, as recorded in said Jefferson
County, said southwest corner being the True
Point of Beginning; thence southerly 275.25
feet, more or less, parallel with the west line
of the northeast l/4 of said section 27, to a
point on the north right-of-way line of West
35th Avenue; thence westerly 40 feet along said

north right-of-way line of West 35th Avenue;
thence northerly 275.25 feet, more or less,
parallel with the west line of the northeast
1/4 of said section 27; thence easterly 40 feet
to the True Point of Beginning. Said parcel
contains 0.25 acres, more or less.

Provided, however, that there is reserved to
the city and to providers of public utilities
an easement within the vacated property, which
easement shall be used for the purpose of
maintaining public utilities within said
property.
Section 2. Upon the vacation accomplished hereby, title to
the property vacated shall revert by operation of C.R.S. 1973, 43-
2-02.
section 3. Severability. If any clause, sentence, paragraph,
or part of this ordinance or the application thereof to any person
or circumstances shall for any reason be adjudged by a court of
competent jurisdiction invalid, such judgment shall not affect
application to other persons or circumstances.
Section 4. Safety Clause. The city council hereby finds,
determines, and declares that this ordinance is promulgated under
the general police power of the City of Wheat Ridge, that it is
promulgated for the health, safety, and welfare of the public, and
that this ordinance is necessary for the preservation of health and
safety and for the protection of public convenience and welfare,
The city council further determines that the ordinance bears a
rational relation to the property legislative object sought to be
attained.
section 5. This ordinance shall take effect one day after
final publication.
INTRODUCED, READ, AND ADOPTED on first reading by a vote of
8 to 0 on this 28th day of October , 1991,
ordered published in full in a newspaper of general circulation in
the city of Wheat Ridge and Public Hearing and consideration on
final passage set for December 9 , 1991, at
7:30 o'clock p.m., in the Council Chambers, 7500 West 29th Avenue,
Wheat Ridge, Colorado.
