TITLE: AN ORDINANCE VACATING A PORTION OF WEST 36TH PLACE
BETWEEN VANCE STREET AND UPHAM STREET (Case No. WV-91-8)
AT APPROXIMATELY 3600 VANCE STREET WITHIN THE CITY OF
WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF COLORADO.
WHEREAS, a certain street known as West 36th Place was dedicated
to the public; and

WHEREAS, that portion of said dedicated West 36th Place is no
longer needed for use by the public; and
WHEREAS, said part of said West 36th Place lies within the City
of t'Jheat Ridge, County of Jefferson, State of Colorado; and

WHEREAS, no land would, by vacation of a part of said street, be
left without an established public road connecting it with another
established public road; and
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT
RIDGE, COLORADO AS FOLLOWS:
Section 1. The following portion of West 36th Place between
Upham Street and Vance Street, a dedicated street within the City of
Wheat Ridge, County of Jefferson, State of Colorado, is hereby
vacated, to wit:
A parcel of land in the north 1/2 of Section
26, Township 3 South, Range 69 West of the 6th
Principal Meridian, City of Wheat Ridge, County
of Jefferson, State of Colorado, more
particularly described as follows:
The South 29 feet of the East 260.31 feet of the
West 768.98 feet of the North 1/2 of the Northwest
1/4 of the Northeast 1/4 of Section 26 Township 3
South Range 69 West of the 6th Principal Meridian.
Said parcel containing 7,549 square feet more or
less.
Provided, however, that there is reserved to the
City and to providers of public utilities an
easement within the vacated property, which
easement shall be used for the purpose of
maintaining public utilities within said property.
Section 2. Upon the vacation accomplished hereby, title to the
property vacated shall revert by operation of C.R.S. 1973, 43-2-302.
Section 3. Severability. If any clause, sentence, paragraph,
or part of this Ordinance or the application thereof to any person or
circumstances shall for any reason be adjudged by a court of competent
jurisdiction invalid, such judgment shall not affect, impair or
invalidate the remainder of this ordinance or its application to other
persons or circumstances.
Section 4. Safety Clause. The City Council hereby finds,
determines, and declares that this ordinance is promulgated under the
general police power of the City of Wheat Ridge, that it is
promulgated for the health, safety, and welfare of the public, and
that this Ordinance is necessary for the preservation of health and
safety and for the protection of public convenience and welfare. The
City Council further determines that the ordinance bears a rational ~
relation to the proper legislative object sought to be attained.
Section 5. This Ordinance shall take effect one day after final
publication.
INTRODUCED, READ, AND ADOPTED on first reading by a vote of ~ to ~
on this 9th day of March , 1992, ordered published in full
in a newspaper of general circulation in the City of Wheat Ridge and
Public Hearing and consideration on final passage set for Monday,
April 13 , 1992, at 7:30 o'clock p.m., in the Council Chambers,
7500 West 29th Avenue, Wheat Ridge, Colorado.
READ, ADOPTED AND ORDERED PUBLISHED on second and final reading by a
vote of 6 to 2 ,this 13th day of Apri 1 , 1992.
