HomeMy WebLinkAboutOrdinance-1992-0897 INTRODUCED BY COUNCILMEMBER Selstad COUNCIL BILL NO. 13 Ordinance No. 897 Series of 1992 TITLE: AN ORDINANCE AMENDING VARIOUS PROVISIONS OF ARTICLE II OF CHAPTER 25, URBAN RENEWAL AUTHORITY, OF THE CODE OF LAWS OF THE CITY OF WHEAT RIDGE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT: Section 1. Section 25-22. Declaration of need for authority, of the Code of Laws of the City of Wheat Ridge is hereby repealed and reenacted as follows: The city council hereby declares that it is in the public interest for an urban renewal authority, created pursuant to the Urban Renewal Law (C.R.S. S 31-25-101 et seq.), to function within the city and to exercise the powers provided therein, EXCEPT AS THE SAME MAY BE LIMITED, CONSTRAINED OR PROSCRIBED BY ANY APPROVED AND ADOPTED URBAN RENEWAL PLAN. Section 2. Section 25-23. Economic development and revitalization commission established--Rights and duties generally, of the Code of Laws of the City of Wheat Ridge is hereby repealed and reenacted as follows: The Wheat Ridge Economic Development and Revitalization commission is hereby organized and established. Such commission is hereby vested with all of the rights contained, and is authorized to carry out all of the duties and function as provided, in the Urban Renewal Law (C.R.S. S 31-25-101 et seq.), as it now exists or as amended in the future, UNLESS SAID POWERS AND AUTHORITIES ARE LIMITED OR CONSTRAINED BY OR WITHIN ANY APPROVED URBAN RENEWAL PLAN; provided, however, that the use of eminent domain shall not be undertaken without the approval of the majority of the city council having first been obtained. Section 3. Section 25-24. number, of the Code of Laws of the repealed and reenacted as follows: Same--Appointment of members; city of Wheat Ridge is hereby The commission shall consist of nine (9) commissioners, two (2) of such commissioners being from each of the existing, or hereafter altered, city council districts, and one (1) commissioner to serve at large. Each appointment to the commission shall be made by the mayor subject to approval by majority vote of the entire city council. The term of office of each commissioner shall be five (5) years. ANY COMMISSION MEMBER WHO SHALL CHANGE HIS PERSONAL RESIDENCE TO AN ADDRESS OUTSIDE THE CITY OR OUTSIDE THE DISTRICT HE REPRESENTS SHALL CEASE TO BE A MEMBER OF THE COMMISSION, AND HIS SEAT SHALL AUTOMATICALLY BE DEEMED VACANT AS OF THE DATE ON WHICH HE CEASED TO BE A RESIDENT OF THE CITY OR OF THE DISTRICT. MEMBERS WHOSE TERM HAS EXPIRED SHALL CONTINUE TO HOLD OFFICE UNTIL HIS SUCCESSOR HAS BEEN APPOINTED AND HAS QUALIFIED. Terms of office shall be staggered so that the term of at least one (1) commissioner shall expire each year. Section 4. Severability. If any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect application to other persons or circumstances. Section 5. Safety Clause. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the city of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The city Council further determines that the ordinance bears a rational relation to the property legislative object sought to be attained. Section 6. This ordinance shall become effective 1 day(s) after final publication.
