TITLE.
At"l ORDINANCE TO AMEND ARTICLE X, MASSAGE PARLOR CODE
OF THE CODE OF LAWS OF THE CITY OF \VHEAT RIDGE BY
EXEMPTING MASSAGE THERAPIST FROM COVERAGE '
WHEREAS, the Colorado General Assembly has amended the state statute on
massage parlors to exempt massage therapist; and
WHEREAS, the City of Wheat Ridge desires its Massage Parlor Ordinance to
conform to the state's statute.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT
RIDGE, COLORADO, THAT:
Section 1. Sections 16-226 (g) and (h) of the Code of Laws of the City of Wheat
Ridge are hereby amended as follows:
Sec. 16-226. Same-Persons and establishments exempted.
The following classes of persons are exempted from this article'

(g) Hospitals, clinics, nursing and convalescent homes, and other similarly
licensed institutions where massages and baths may be given are
excluded from the definition of a health service establishment.
(h) A facility which is operated for the purpose of massage therapy
performed by a massage therapist is exempted from this article. For
purposes of this subsection, 'massage therapist' means a person who
has graduated from a massage therapy school accredited by the state
educational board or division charged ,,,ith the responsibility of
approvmg private occupational schools, or from a school with
comparable approval or accreditation from another state WIth
transcnpts mdicatmg completion of at least five hundred (500) hours
of training in massage therapy. For the purposes of this subsection,
a massage therapy school may include an equivalency program
approved by the state educational board or diVIsion charged with the
responsibility of approving private occupational schools.
Section 2. Severahilitv. If any clause, sentence, paragraph, or part of thiS ordinance
or the applicatlon thereof to any person or circumstances shall for any reason be adjudged
by a court of competent jurisdiction invalid, such judgment shall not affect application to
other persons or circumstances.

Section 3. Safety Clause. The City Council hereby finds, determines, and declares
that this ordinance is promulgated under the general police power of the City of Wheat
Ridge, that It is promulgated for the health, safety, and welfare of the public, and that this
ordinance is necessary for the preservation of health and safety and for the protection of
public convemence and welfare. The City Council further detenmnes that the ordinance
bears a rational relation to the property legislative object sought to be attained.
Section 4. This ordinance shall become effective 15 day(s) after final publication.
