TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF REZONING
FROM AGRICULTURAL-ONE TO PLANNED COMMERCIAL
DEVELOPMENT (PCD) AND FOR APPROVAL OF A COMBINED
OUTLINE AND FINAL DEVELOPMENT PLAN AND PLAT ON LAND
LOCATED AT APPROXIMATELY 5000 ROBE STREET, CITY OF
WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO, THAT:
Section 1: Upon application by Richard Todd for Phillip Haas for
approval of rezoning in Wheat Ridge, Colorado, Case No. WZ-92-7,
and based upon recommendation for approval from the Wheat Ridge
Planning Commission, and pursuant to findings made based on
testimony and evidence presented at public hearing before the
Wheat Ridge City Council, Wheat Ridge maps are hereby amended to
exclude from the Agricultural-One District and to include in the
Planned Commercial Development District, the following described
land:
A TRACT OF LAND SITUATED IN THE SWlj4 OF SECTION 16,
SOUTH, RANGE 69 WEST, OF THE 6TH PRINCIPAL MERIDIAN,
WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF COLORADO.
BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
TOWNSHIP 3

SAID TRACT
BEGINNING AT THE SOUTHWEST CORNER OF SAID SECTION 16; THENCE
N89026'26"E, 663.61 FEET AND N00017'51"W, 1090.60 FEET TO THE
TRUE POINT OF BEGINNING;
THENCE N00017'5l"W, 229.60 FEET;
THENCE N89029'40"E, 664.19 FEET;
THENCE S00016'19"E, 229.60 FEET;
THENCE S89029'40"W, 664.09 FEET TO THE TRUE POINT OF
BEGINNING. SAID TRACT CONTAINING 3.50 ACRES, MORE OR LESS.
Section 2. Vested Property Rights. Approval of this combined
outline and final development plan and plat does not create a
vested property right. Vested property rights may only arise and
accrue pursuant to the provisions of Section 26(c) of Appendix A
of the Code of Laws of the City of Wheat Ridge.
Section 3. Safety Clause. The City Council hereby finds,
determines, and declares that this ordinance is promulgated under
the general police power of the City of Wheat Ridge, that it is
promulgated for the health, safety, and welfare of the public,
and that this Ordinance is necessary for the preservation of
health and safety and for the protection of public convenience
and welfare. The City Council further determines that the
ordinance bears a rational relation to the proper legislative
object sought to be attained.

Section 4. Severabili~ If any clause, sentence, paragraph, or
part of this Zoning Code or the application thereof to any person
or circumstances shall for any reason be adjusted by a court of
competent jurisdiction invalid, such judgment shall not affect
application to other persons or circumstances.
Section 5. This ordinance shall take effect 15
