TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF A SPECIAL
USE PERMIT TO ALLOW AN ENVIRONMENTAL TRAINING CENTER
IN AN INDUSTRIAL ZONE DISTRICT ON PROPERTY LOCATED
AT 5040 TABOR STREET, CITY OF WHEAT RIDGE, COUNTY OF
JEFFERSON, STATE OF COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO, THAT:
Section 1. Upon application by Urie Environmental Health, Inc.
for approval of a Special Use Permit in Wheat Ridge, Colorado,
Case No. SUP-93-3, and based upon a recommendation for approval
from the Wheat Ridge Planning Commission and pursuant to findings
made based on testimony and evidence presented at a public
hearing before the Wheat Ridge City Council, a Special Use Permit
to allow an environmental training center in an Industrial zone
district is hereby approved for the following described land:
That portion of Lot 19, Standley Heights, which begins at a point
formed by the intersection of the East line of Tabor Street with
the Southerly right-of-way line of the Colorado and Southern
Railroad right-of-way, which point of beginning lies 348.6 feet,
more or less, North of the South line of said Lot 19; thence
South along the said East line of Tabor Street 213 feet to a
point; thence East and parallel with the South line of said Lot
19; a distance of 642.9 feet to a point on the East line of said
Lot 19; thence North along the East line of Lot 19 a distance of
389.7 feet to a point on the Southerly right-of-way line of the
Colorado and Southern Railway, thence southwesterly along said
Southerly right-of-way line a distance of 660 feet more or less
to the point of beginning, County of Jefferson, State of
Colorado.
Section 2. Vested Property Rights. Approval of this Special Use
Permit does not create a vested property right. Vested property
rights may only arise and accrue pursuant to the provisions of
Section 26(c) of Appendix A of the Code of Laws of the City of
Wheat Ridge.
Section 3. Safety Clause. The City Council hereby finds,
determines and declares that this ordinance is promulgated under
the general police power of the City of Wheat Ridge, that it is
promulgated for the health, safety and welfare of the public, and
that this ordinance is necessary for the preservation of health
and safety and for the protection of public convenience and
welfare. The City Council further determines that the ordinance
bears a rational relation to the proper legislative object sought
to be attained.

Section 4. This Ordinance shall take effect one day after final
publication.
INTRODUCED, READ, AND ADOPTED on first reading by a vote of -1L
to ~ on this 27th day of September ,1993, ordered
published in full in a newspaper of general circulation in the
City of Wheat Ridge and Public Hearing and consideration on final
passage set for October 25 , 1993, at 7:30 o'clock p.m., in
the Council Chambers, 7500 West 29th Avenue, Wheat Ridge,
Colorado.
