HomeMy WebLinkAboutOrdinance-1994-0957 INTRODUCED BY COUNCILMEMBER Council Bill No. 45 Series BEHM ORDINANCE NO. of 1994 957 TITLE: AN ORDINANCE REPEALING AND REENACTING SECTION 11-64 OF CHAPTER 11, ARTICLE III, OF THE CODE OF THE CITY OF WHEAT RIDGE, COLORADO, PERTAINING TO LIQUOR OCCUPATION TAXES BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO: Section 1. Section 11-64, of Chapter 11, Article III of the Code of the city of Wheat Ridge, Colorado, is hereby repealed and reenacted as follows: Section 11-64. Amount of tax levied. There is hereby levied and assessed for each year an annual occupation tax upon the business of selling 3.2 per cent (3.2%) beer, malt, vinous, or spirituous liquors, except medicinal liquors, in the City as such occupation has been herein classified, as follows: (1) For all Class G operators, Nine Hundred Dollars ($900) ; (2) For all Class F operators, six Hundred Dollars ($600) ; (3) For all Class D operators, six Hundred Fifty Dollars ($650); (4) For all Class E operators, six Hundred Dollars ($600) ; (5) For all Class C operators, Nine Hundred Dollars ($900) ; (6) For all Class J-1 operators, Seven Hundred Dollars ($700) ; (7) For all Class J-2 operators, Seven Hundred Dollars ($700) ; (8) For all Class J-3 operators, Two Thousand Two Hundred Dollars ($2,200); (9) For all Class T operators, One Thousand Three Hundred Dollars ($1,300); Section 2. Any increase in liquor occupation taxes from taxes imposed in calendar year 1993 shall be paid to the City as a supplemental payment no later than May 1, 1994. Section 3. Safetv Clause. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the city of Wheat Ridge; that it is promulgated for the health, safety and welfare of the public, and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to these objectives. Section 4. Severabilitv. If any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect application to other persons or circumstances. section 5. This ordinance shall become effective upon its passage by the City Council.
