COLORADO PG: 0001-003 9/23/1998 8:57:54 1-,3 00; \\9 INTRODUCED BY COUNCIL MEMBER HALL Council Bill No. 60 ORDINANCE NO. 972 Series of 1994 TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF REZONING FROM AGRICULTURAL-ONE (A-l) AND RESIDENTIAL-TWO (R-2) TO PLANNED COMMERCIAL DEVELOPMENT (PCD) AND FOR APPROVAL OF AN OUTLINE AND FINAL DEVELOPMENT PLAN ON LAND LOCATED AT 4650 KIPLING STREET, CITY OF WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF COLORADO. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT: Section 1. Upon application by Johnny Ketelsen Recreation Vehicles, Inc. for approval of rezoning in Wheat Ridge, Colorado, Case No. WZ-94-2 and based upon recomme~dation for approval, with conditions from the Wheat Ridge Planning Commission, and pursuant to findings made based on testimony and evidence presented at public hearing before the Wheat Ridge City Council, Wheat Ridge maps are hereby amended to exclude from the Agricultural-One and Residential-Two District and to include in the Planned Commercial Development District, the following described land: That part of the Northwest quarter of the Northwest quarter of Section 22, Township 3 South, Range 69 West of the Sixth Principal Meridian, City of Wheat Ridge, County of Jefferson, State of Colorado, described as follows: Commencing at the Northwest corner of said Section 22; Thence SOOo09'00"W, 662.97 feet, along the West line of the Northwest quarter, to the Northwest corner of the SW 1/4 of the NW 1/4 of the NW 1/4 of said Section 22; thence N69053'52''E 45.00 feet, along the North line of said SW 1/4 of Hle NW 1/4 of the NW 1/4, to the East line of Kipling Street, and Point of Beginning, thence, continuing along the last described line, N89053'52''E 656.73 feet; Then the following six courses: 1. SOOo07'44"W, 331.19 feet, to the South line of the NE 1/4 of the SW 1/4 of the NW 1/4 of the NW 1/4; 2. S89052'24''W, 41.03 feet, along the last described line to the Southwest corner of the NE 1/4 of the SW 1/4 of the NW 1/4 of the NW 1/4; 3. S89052'28''W, 110.14 feet, along the South line of NW 1/4 of the SW 1/4 of the NW 1/4 of the NW 1/4; 4. NOOo08'10"E, 131.25 feet; 5. S89oS3'52"W, 505.65 feet, to the East line of Kipling Street; 6. NOOo09'OO"E, 200.00 feet, more or less, to the Point of Beginning, containing 3.47 acres, more or less. Ordinance No. 972 Series of 1994 Page 2 ?- Section 2. Conditions. The Outline Development Plan, attached hereto and incorporated herein, is hereby adopted and shal1 serve as a general guideline for the future development and use of the legally described property. Prior to development and use of the property, preliminary and final development plans, and a subdivision plat must be approved in accordance with Wheat Ridge Code of Laws, Appendix A., Section 20. Right to develop shall not accrue until the Final Planned Commercial Development Plan and Subdivision Plat have been legal1y approved by the Wheat Ridge Planning Commission and City Council and recorded with the Jefferson County Clerk and Recorder, and subject to meeting all other requirements as provided by the Wheat Ridge City Charter and the Wheat Ridge Code of Laws. Section 3. Safety Clause. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative object sought to be attained. Section 4. Severabilitv. If any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shal1 not affect, impair or invalidate the remainder of this ordinance or its application to other persons or circumstances. Section 5. This ordinance shall take effect final publication. 15 days after INTRODUCED, READ, AND ADOPTED on first reading by a vote of 8 to --L on this 13th day of June , 1994, ordered - published in full in a newspaper of general circulation in the City of Wheat Ridge and Public Hearing and consideration on final passage set for July 11 , 1994, at 7:00 o'clock p.m., in the Council Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado.
