AN ORDINANCE AMENDING ORDINANCE 1002, SERIES OF 1995, AN
ORDINANCE VACATING A PORTION OF MILLER STREET BETWEEN 2
WEST 41ST AVENUE AND WEST 39TH AVENUE WITH IN THE CITY OF I :/
WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF COLORADO --
WHEREAS, by Ordinance No. 1002, Series 1995, adopted on
June 12, 1995 and filed for record with the Jefferson County Clerk
and Recorder on July 14, 1995 at Reception No. F0083603, the city
of Wheat Ridge vacated a portion of Miller street lying within the
City; and
WHEREAS, the legal description of the vacated portion of
Miller street contained in said ordinance was in error; and
WHEREAS, said part of said Miller street lies within the
City of Wheat Ridge, County of Jefferson, State of Colorado; and is
not needed by the City for roadway or right-of-way purposes; and
WHEREAS, no property will be denied access to a public
street by vacation of a portion of Miller street, as described
herein.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT
RIDGE, COLORADO, AS FOLLOWS:
Section 1 of Ordinance No. 1002, Series 1995 is hereby
amended to describe the following portion of Miller Street, a
dedicated street within the City of Wheat Ridge, County of
Jefferson, state of Colorado, as vacated, to wit:
A tract of land lying in the SE 1/4 of Section
21, Township 3 South, Range 69 West of the 6th
Principal Meridian, City of Wheat Ridge,
County of Jefferson, State of Colorado,
described as:
The South 804.67 feet of those parcels of land
described in the official records of the
County of Jefferson, State of Colorado in Book
893 at Page 216 and Book 1217 at Pages 195 and
196: Together with the North 449.77 feet of
the parcel of land described in the official
records of the County of Jefferson, state of
Colorado in Book 205 at Page 348 and further
described as:

commencing at the Southeast corner of said
SE 1/4 of section 21, Thence N 88050'11" W
1321.37 feet to the TRUE POINT OF BEGINNING.
Thence N 11'47" W 449.77 feet, thence continu-
ing N 11'47" W 804.67 feet to the South line
of West 41st Avenue. Thence along said South
line S 89"24'00" W 25 feet, thence
S 0"11'47" E 804.67 feet, thence N 89"24'00" E
18.13 feet, thence S 0"18'14" E 449.78 feet,
thence N 89"12'43" E 6.02 feet to the TRUE
POINT OF BEGINNING.

another and are based on the bearing of the
South line of the SE 1/4 of said section 21
being S 89"12'43" W.
Said tract containing 23,016.61 square feet or
0.5284 Acres, more or less.
Also known as a portion of Miller Street,
Wheat Ridge, Colorado, 80033
section 2. Safetv Clause. The city Council hereby
finds, determines, and declares that this ordinance is promulgated
under the general police power of the City of Wheat Ridge, that it
is promulgated for the health, safety, and welfare of the public
and that this ordinance is necessary for the preservation of health
and safety and for the protection of public convenience and wel-
fare. The city Council further determines that the ordinance bears
a rational relation to the proper legislative object sought to be
attained.
section 3. Severabilitv. If any clause, sentence, para-
graph, or part of this ordinance or the application thereof to any
person or circumstances shall for any reason be judged by a court
of competent jurisdiction invalid, such judgment shall not affect,
impair or invalidate the remainder of this ordinance or its appli-
cation to other persons or circumstances.
section 4. This ordinance shall take effect fifteen days
after final publication.
INTRODUCED, READ, AND ADOPTED on first reading by a vote
of 8 to 0 on this 23rd day of October , 1995, ordered
published in full in a newspaper of general circulation in the City
of Wheat Ridge and Public Hearing and consideration on final
passage set for November 27 , 1995, at 7:00 o'clock p.m., in the
Council Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado.
