TITLE.
AN ORDINANCE PROVIDING FOR THE APPROVAL OF REZONING
FROM AGRICULTURAL-ONE AND RESIDENTIAL-THREE TO
AGRICULTURAL-ONE AND RESIDENTIAL-ONE ON LAND LOCATED
AT 4430 TABOR STREET, CITY OF WHEAT RIDGE, COUNTY OF
JEFFERSON, STATE OF COLORADO
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO, THAT
Section 1. Upon application by Rodney W Fisher and Diane L. Davison tor approval
of a rezoning, in Wheat Ridge, Colorado, Case No WZ-95-18 and based on
recommendation for approval from the Wheat Ridge Planning Commission, and
pursuant to findings made based on testimony and evidence presented at a public
hearing before the Wheat Ridge City Council, Wheat Ridge maps are hereby amended
to exclude from the A-1 and R-3 district, and to include in the A-1 and R-1 the
following described land
A parcel of land lying within the west one-ha If of Lots 13 and 14, Lees SubdivIsion
described as follows
Beginning at the southwest corner of said Lot 13, thence N 00027'32" W, 21653 feet
along the west line of said Lot 13 to the True Point of Beginning; thence N OOC 27'32"
W 360.27 feet along the west line of said Lots 13 and 14 to the northwest corner of
that parcel of land as described in Reception No 88045786, Jefferson County
Records; thence N 89012'06" E, 312.78 feet along the north line of said Reception No
88045786 to the west line of that parcel of land as described In Reception No
92112784 Jefferson County Records, thence S 00028'41" E, along said west line
36555 feet; thence N 89050'12" W, 312.91 feet to the True Point of Beginning,
containing 2.6 acres, more or less
Section 2. Vested Property Riqhts. Approval of this rezoning does not create a vested
property right Vested property rights may only arise and accrue pursuant to the
provisions of Section 26(c) of Appendix A of the Code of Laws of the City of Wheat
Ridge
Section 3. Safety Clause. The City Council hereby finds, determines, and declares
that this ordinance is promulgated under the general police power of the City of Wheat
Ridge, that it is promulgated for the health, safety, and welfare of the public and that
this ordinance is necessary for the preservation of health and safety and for the
protection of public convenience and welfare. The City Council further determines that
the ordinance bears a rational relation to the proper legislative object sought to be
attained.

Section 4. Severabilitv. If any clause, sentence, paragraph, or part of this ordinance
or the application thereof to any person or circumstances shall for any reason be
judged by a court of competent jurisdiction invalid, such judgement
shall not affect, impair or invalidate the remainder of this ordinance or its application to
other persons or circumstances
Section 5. This ordinance shall take effect 15 _ days after final publication
INTRODUCED, READ, AND ADOPTED on first reading by a vote of ~ to ~ on
