Section 1. Chapter 26, Article I, Section 26-30(S) of the Wheat Ridge Code of Laws, entitled "Exterior Lighting Standards", is hereby amended as follows: CHAPTER 26 ZONING AND DEVELOPMENT ARTICLE I. ZONING CODE (S) Exterior Lighting Standards: (1) Purpose. The purpose of this section is to regulate the spillover of light and glare from exterior lighting on operators of motor vehicles, pedestrians and land uses in the proximity of the light source. With respect to motor vehicles in particular, safety considerations form the basis of the regulations contained herein. In other cases, both the nuisance and hazard aspects of glare, reflected light and incidental spillover light are regulated. This section is not intended to apply to public street lighting or to public outdoor parks and recreation uses. (2) Performance Standards: (a) All exterior lighting shall be designed and situated so that substantially all of the directly-emitted light falls within the property boundaries. (b) Exterior lighting shall also be designed and situated so that no incidental or reflected light interferes with reasonable enjoyment of adjacent land uses, nor safe movement of motor vehicles on public streets. (c) The following exterior lighting is specifically prohibited: (1) Any light that may be confused with or construed as a traffic control device. (2) Any animated, flashing or changing intensity lights, except for temporary holiday displays. (3) Permit Required. An electrical permit application shall be required, and a permit issued, prior to installation or substantial modification of any exterior lighting. Such permit application shall be accompanied by information as may be required by the Uniform Electrical Code, and additional information that may be necessary to determine potential negative affects upon adjacent properties and public streets including, but not limited to, a plot plan showing location and orientation of lighting standards, building elevations showing location and orientation of lighting standards, lighting standard specifications including height, type (i.e., cut-off, non- cut-off, spot flood light, etc.), peak candlepower diagram, and any shielding devices to be incorporated so as to minimize incidental light spillover or glare. It Ehall have been teEted, calibrated, and certified by an independent commercial photometric laboratory or the manufacturer within one (1) year of the date of ItE iREtallation. (b) Method of meaEurement: The meter sensor Ehall be mounted not more than Eix (6) inches abo\'e ground level in a horizoRtal pOEition. ReadingE Ehall be taken by qualified persormel only after the cell Ras been expoEed long enough to provide a conEtant reading. Measurements sRall be made after dark with the light sourceE in questioR OR, then witR tRe same EourceE off. The difference between the two readingE shall be compared to the maximum permitted illumination and property line at ground level. ThiE procedure eliminates the effectE of moonlight and other ambient light. (5) !;:xterior lighting plan. At the time any exterior lighting is propoEed to be inEtalled or EubEtantially modified, an exterior lighting plaR Ehall be submitted to the zORing administrator in order to determine '::Rether the requirementE of thiE EectloR have been met-.- Section 2. Severabilitv. If any clause, sentence, paragraph, or part of this Zoning Code or the application thereof to any person or circumstances shall for any reason be adjusted by a court of competent jurisdiction invalid, such judgment shall not affect application to other persons or circumstances. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative object sought to be attained. Section 4. This ordinance shall take effect ~ days after final publication.
