TITLE:
AN ORDINANCE PROVIDING FOR THE APPROVAL OF REZONING
FROM AGRICULTURAL-ONE TO PLANNED INDUSTRIAL
DEVELOPMENT DISTRICT AND FOR APPROVAL OF AN OUTLINE
DEVELOPMENT PLAN ON LAND LOCATED AT 4951 MILLER
STREET, CITY OF WHEAT RIDGE, COUNTY OF JEFFERSON, STATE
OF COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO, THAT:
SectIOn 1. Upon applicatIon by W.R. Miller Properties LLP for approval of a rezoning m Wheat
RIdge, Colorado, Case No WZ-97-2 and based on recommendation for approval from the Wheat
RIdge Planning Commission, and pursuant to findings made based on testimony and eVIdence
presented at public heanng before the Wheat Ridge CIty Council, Wheat Ridge maps are hereby
amended to exclude from the Agricultural-One district, and to include m the Planned Industnal
Development dIstnct the following described land:
A parcel ofland situated m the northwest quarter of Section 29, T 3 S., R. 69 W. of the 6th P.M.,
County of Jefferson, State of Colorado, described as follows.
THA T PART OF THE SOUTHWEST ONE-QUARTER OF THE SOUTHEAST ONE-QUARTER OF
SECTION 16, TOWNSHIP 3 SOUTH, RANGE 69 WEST OF THE 6TH PRINCIPAL MERIDIAN,
MORE PARTICULARLY DESCRIBED AS FOLLOWS
BEGINNING AT A POINT WHENCE THE SOUTHEAST CORNER OF THE SOUTHWEST ONE-
QUARTER OF THE SOUTHEAST ONE-QUARTER OF SAID SECTION BEARS SOUTH 0030' WEST
961 0 FEET, WHICH POINT IS THE INTERSECTION OF THE NORTH-SOUTH CENTER LINE OF
THE SOUTHEAST ONE-QUARTER OF SAID SECTION, WITH THE NORTHERLY LINE OF THE
PUBLIC SERVICE COMPANY RIGHT OF WAY. THENCE SOUTHWESTERLY ALONG SAID
RIGHT OF WAY LINE A DISTANCE OF 3\ 19 FEET TO THE TRUE POINT OF BEGINNING SAID
POINT BEING 30 00 FEET WEST OF SAID NORTH-SOUTH CENTER LINE OF SAID SOUTHEAST
ONE-QUARTER OF SECTION 16, THENCE CONTINUING SOUTHWESTERLY ALONG SAID
NORTHERLY RIGHT OF WAY LINE A DISTANCE OF 404.297 FEET, THENCE NORTH
PARALLEL TO SAID NORTH-SOUTH CENTER LINE OF SAID SOUTHEAST ONE-QUARTER A
DISTANCE OF 1\2.00 FEET, THENCE NORTHEASTERLY PARALLEL WITH SAID NORTHERLY
RIGHT OF WAY LINE A DISTANCE OF 404.297 FEET TO A POINT 30 FEET WEST OF THE
NORTH-SOUTH CENTER LINE OF SAID SOUTHEAST ONE-QUARTER, THENCE SOUTH
PARALLEL WITH AND 30 FEET WEST OF SAID NORTH-SOUTH CENTER LINE OF SAID
SOUTHEAST ONE-QUARTER A DISTANCE OF 112.00 FEET TO THE TRUE POINT OF
BEGINNING, COUNTY OF JEFFERSON, STATE OF COLORADO
SectIon 2. Vested Property Rights. Approval of this rezoning does not create a vested property
right. Vested propeny rights may only arise and accrue pursuant to the provisions of SectIon
26(c) of AppendIx A ofthc Code of Laws of the City of Wheat Ridge.

SectIOn 3. Safety Clause. The CIty CouncIl hereby finds, determmes, and declares that this
ordinance IS promulgated undcr the general pollcc power of the City of Wheat RIdge, that it is
promulgated for the health, safety, and welfare of the public and that this ordmance is necessary
for the preservatIOn of health and safety and for the protection of public convemence and welfare.
The CIty Council further detcrmines that the ordmance bears a ratIOnal relatIOn to the proper
legislatIve object sought to be attained.
SectIon 4. SeverabIlity. If any clause, sentence, paragraph, or part of this ordinance or the
applicatIOn thereof to any person or circumstances shall for any reason be judged by a court of
competent JunsdIctIOn mvalid, such Judgement
shall not affect, Impair or invalidate the remainder of thIS ordinance or its application to other
persons or circumstances.
Section 5. ThIS ordmance shall take effect 15 days after final publIcation.
