HomeMy WebLinkAboutOrdinance-1997-1075 CITY OF WHEAT RIDGE, COLORADO INTRODUCED BY COUNCIL MEMBER Worth Council Bill No 12 Ordinance No 107 S Series of 1997 TITLE: AN ORDINANCE REDUCING THE SALES TAX VENDOR'S FEE TO ZERO WHEREAS, the Wheat Ridge Code of Laws presently provides for a vendor's fee of up to $100 per reporting period, and WHEREAS, the City Council desires to reduce said fee to zero BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO. Section 1 The definition of "Vendor's fee" found in Section 22-21 of the Code of Laws IS amended to read Vendor's fee: The portion of total sales tax collected by a licensed taxpayer under the requirements of this chapter that the taxpayer may retain as payment or offset for his expense in collecting and remitting the sales tax collected from taxable sales and leases to purchasers and consumers The vendor's fee may only be retained when sales tax collected has been remitted to the city as prescribed In this chapter The vendor's fee IS spocificJlly limitod to J mJ)(imum of one hundrod dollJrs ($100.00) por roporting poriod, JS spocifiod horoin SET FORTH AT SECTION 22-40(b) OF THIS CHAPTER Section 2. Section 22-40(b) of the Code of Laws is amended to read (b) The vendor's fee, asdefined in section 2221, shall be two (2) ZERO (0) percent of the total sales tax due to the city under this chapter, up to a maximum vendor's fee of eRe- hundred ($100.00) ZERO ($0 00) dollars per reporting period Section 3. Safety Clause The City Council hereby finds, determines, and declares that this Ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public and that this Ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare The City Council further determines that the Ordinance bears a rational relation to the proper legislative object sought to be attained Section 4 Severability; Conflictinq Ordinances Repealed If any section, subsection or clause of this ordinance shall be deemed to be unconstitutional or otherWise invalid, the validity of the remaining sections, subsections and clauses shall not be affected thereby All GF[y. ~302T 180878.1 other ordinances or parts of ordinances In conflict with the provisions of this ordinance are hereby repealed Section 5 Effective Date This Ordinance shall take effect on 1" l <;'<;'0., y<L. 1997.
