AN ORDINANCE PROVIDING FOR THE APPROVAL OF REZONING FROM
COMMERCIAL-ONE TO PLANNED INDUSTRIAL DEVELOPMENT DISTRICT
AND FOR APPROVAL OF AN OUTLINE DEVELOPMENT PLAN ON LAND
LOCATED AT 9500 WEST 49TH AVENUE, CITY OF WHEAT RIDGE, COUNTY
OF JEFFERSON, STATE OF COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO,
THAT:
Section 1. Upon applIcatIOn by Pacifica Holdmg Company LLC for approval of a rezonmg in Wheat
Ridge, Colorado, Case No WZ-97-10 and pursuant to findings made based on testImony and evidence
presented at public hearIng before the Wheat Ridge City Council, Wheat Ridge maps are hereby amended
to exclude from the Commercial-One dIstrIct, and to mclude m the Planned mdustrial Development
distrIct the followmg described land.
Lots], 2, 3, and 4 of 70 ExecutIve Center Amended SubdIVISIOn, City of Wheat Ridge, County of
Jefferson. State of Colorado.
SectIOn 2. CondItIOns.
1 The following uses are allowed: All RCI, R-C and C-l uses except the followmg. Adult
entertamrnent faCIlIties, automobile and light-duty truck sales and rental, auto service and repair
shops, hotels and motels, mortuaries and crematories, motor fuelmg stations, drive-m restaurants,
roommg and boardmg houses, lumber yards, pawn shops, taverns and night clubs, theaters.
Additional permitted uses. Research laboratOrIes, retail and wholesale sales of equipment, supplies
and materIals for use m agrIcultural, mming industry, busmess, transportation, bUlldmg and
construction, schoo] for mdustrial or business trammg, printing and engravmg, wholesale
busmesses, manufactUrIng, processmg and warehousmg, lIght industrial operations, warehousmg

2. Semi-trucks and traIlers be allowed on the property for pickup and delivenes only All service
tractors may not be parked more than one hour before loading or unloading or one hour after
loading or unloadmg. No over night parkmg of semi-trucks may be allowed.
3 No outSIde storage be allowed.
4 No shIft work occur between the hours of 10'00 p.m. and 6'00 a.m..
5 The two eastern bUildings be limited to a 5 HP maximum tor anyone machine.
6 The two western buildmgs be lImIted to a 40 HP maximum for anyone machine.
7 No attachment of additional equipment such as special eqUipment, cranes, lIfts, etc., to outSide
walls or roof will be permItted.
8 No woodworking busmesses wIll be allowed.
9 Item #9 on outlme plan (shops for custom work or for makmg articles, materIals, or commodIties
to be sold tor retail on the premises) shall not be allowed m the eastern bUlldmgs (bUlldmgs 'A'
and 'B').

10 Use of the property shall conform to Wheat Ridge, Code of Laws, section 13-25 DIesel-powered
engme and 15-26(e) Offensive Discharges.
Section 3. Vested Property Rights. Approval of this rezonmg does not create a vested property right.
Vested property rIghts may only arise and accrue pursuant to the proviSIOns of Section 26( c) of AppendiX
A of the Code of Laws of the City of Wheat Ridge.
Section 4. Safety Clause. The CIty Council hereby finds, determmes, and declares that this ordmance IS
promulgated under the general police power of the City of Wheat Ridge, that it IS promulgated for the
health, safety, and welfare of the publIc and that thiS ordmance IS necessary for the preservatIOn of health
and safety and for the protectIOn of public convenience and welfare. The City Council further deternlmes
that the ordinance bears a rational relation to the proper legislatIve obJect sought to be attained.
SectIOn 5. Severability. If any clause, sentence, paragraph, or part of this ordinance or the applicatIon
thereof to any person or circumstances shall for any reason be judged by a court of competent JurisdIction
invalid, such judgement
shall not affect, Impair or mvalIdate the remamder of this ordmance or its applIcatIOn to other persons or
circumstances.
Section 6. ThiS ordinance shall take effect 15 days after final publicatIOn.

Council Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado.
