HomeMy WebLinkAboutOrdinance-1997-1103 CITY OF WHEAT RIDGE, COLORADO INTRODUCED BY COUNCIL MEMBER Council Bill No. 50 Ordinance No. 1103 Si 1 pr Series of 1998 TITLE AN ORDINANCE AMENDING SECTION 5-124 OF THE CODE OF LAWS OF THE CITY OF WHEAT RIDGE TO PROVIDE ADDITIONAL GROUNDS FOR SUSPENSION OR REVOCATION OF CONTRACTOR LICENSES WHEREAS, pursuant to Section 5-1 of the Wheat Ridge City Code of Laws ("the Code"), it is the intent of the City Council to safeguard life and limb, health, property, and the public welfare by regulating and controlling the design, construction, quality of materials, use and occupancy, location and maintenance of all buildings, structures, and utilities within the City, and WHEREAS, the City frequently receives complaints from its citizens regarding the negligence and/or lllcompetence of and unworkmanlike acts commItted by contractors licensed by the City pursuant to Article IV of Chapter 5 of the Code to perform construction, repair, or remodeling of buildings or structures within the City; and WHEREAS, the City Council desires to be more responsive to these citizen complaints BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO. Section 1. Section 5-124(a) of the Wheat Ridge City Code of Laws is hereby amended by the addItion of new subsections (5) and (6) to read Sec. 5-124. Suspension or Revocation. (a) Authority. The director of planning and development may suspend or revoke a class I through class XIV licenses The director of public works may suspend or revoke class A through C licenses License suspension or revocation may occur when the licensee commits one (1) or more of the following acts or omissions (1) (5) COMMITTING ANY ACT OF NEGLIGENCE, INCOMPETENCE, OR MISCONDUCT IN THE PERFORMANCE OF THE CONTRACTOR'S VEM\53027\257450.0 I SPECIFIC TRADE WHICH RESULTS IN A SUBSTANTIAL THREAT TO PUBLIC HEALTH AND SAFETY. (6) PERFORMING UNDER HIS/HER LICENSE IN AN UNWORKMAN- LIKE, CARELESS, OR RECKLESS MANNER. Section 2 Safety Clause The City Council hereby finds, determines, and declares that this ordinance is promulgated under the police powers of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public and that this ordinance is necessary for the preservation of health and safety and for the protection of public convelllence and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative objective sought to be attained Section 3 Severahility If any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or cIrcumstance shall for any reason be judged by a court of competent jurisdiction invalid, such judgment shall not affect, impair, or invalIdate the remalllder of this ordinance or its application to other persons or circumstances .sectIon 4 Effective date This Ordinance shall take effect fifteen days after final publication, as provided by Section 5.11 of the Charter.
