AN ORDINANCE VACATING A PORTION OF WEST 44TH I'"
PLACE(CASE NO. WV-97-3) WITHIN THE CITY OF WHEAT RIDGE, ---~
COUNTY OF JEFFERSON, STATE OF COLORADO. ADJACENT TO
10911-17 W. 44TH PLACE.
WHEREAS, right~of-way was previously dedicated for W. 44th Place between
Parfet Street and Owens Street; and
WHEREAS, said part of said W. 44th Place lies within the City of Wheat Ridge,
County of Jefferson, State of Colorado. and a portion the dedicated right-of-way does not
coincide with the physical street improvements;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO, THAT:
Section 1. The following portion of W. 44th Place, a dedicated street within the City of
\Vheat Ridge, County of Jefferson, State of Colorado, is hereby vacated to wit:
A tract ofland m the SE ; 4 of the NW v., of secl10n 21 , Township 3 South, Range 69 West of the
6th PM" described as follows
Commencmg at the Southeast comer of s31d NW v., of section 21, thence NOO C OO'OO"E on an
assumed beanng along the east lme said NW II" a distance of 1182 63 feet; thence N89 45'25 W a
distance of 13900 feet to a pomt; thence SOO" OO'OO"W parallel with the East Ime said NW v., a
distance of 88.39 feet to the True pomt ofBegmnmg; thence contmumg SOOe 00'00" a distance
29 II feet; thence N890 45'25"W a distance of240 00 feet; thence NOOc OO'OO"E a distance of

Section 2. Conditions.
1 The applicant dedicate land along thiS north em property lme as nght~of~way for West
45th Avenue,
2, A non~excluslve utility easement be reserved over the entIre portion bemg vacated,
Section 3. Vesting Upon the vacatIOn accomplished hereby, title to the property vacated shall
revert to the adjacent property owner of record, More speCifically, the land described above shall
revert to the owner of property addressed as 1 0911 ~ 17 W 44th Place
Section 4. Safety Clause The City Council hereby finds, detemunes, and declares that thiS
ordmance IS promulgated under the general police power of the City of Wheat Ridge, that It IS

Section 5. Severability. If any clause, sentence, paragraph, or part of thIs Zonmg Code or the
applIcatIOn thereofto any person or CIrcumstances shall for any reason be adjusted by a court of
competent Junsdlctlon ll1valId, such Judgment shall not affect applIcatIOn to other persons or
Circumstances,
