TITLE: AN ORDINANCE DESIGNATING THE JOY WILLIAMS BARN,
LOCATED AT 11460 WEST 44TH AVENUE, AS AN HISTORIC
LANDMARK IN THE CITY OF WHEAT RIDGE.
WHEREAS, the City of Wheat Ridge has been presented with an application
for historic designation for the Joy Williams Barn, located at 11460 West 44th
Avenue, pursuant to Article VI of Chapter 26 of the Wheat Ridge Code of Law; and
WHEREAS, the City Council has received and reviewed the recommendation
of the Wheat Ridge Historical Society Board of Directors and has conducted a
public hearing on the proposed designation, all in the manner required by
Section 26-604 of the Wheat Ridge Code of Laws; and
WHEREAS, the City Council is of the opinion that the Joy Williams Barn is
eligible for, and should be designated as, an historic landmark in the City of Wheat
Ridge:
NOW, THEREFORE:
Section 1. Findinas of Fact. The Wheat Ridge City Council hereby finds that
the property owner will retain the ability to earn a reasonable return on the property
following its designation as an historical landmark in the City of Wheat Ridge.
Section 2. Historic landmark Oesianated. Pursuant to the authority vested
in it by Section 26-605 of the Wheat Ridge Code of Laws, the Wheat Ridge City
Council hereby designates the Joy Williams Barn as an historic landmark within the
City of Wheat Ridge. No City of Wheat Ridge funds or manpower shall be used on
this landmark so long as it remains private property, unless the City implements a
future grant program for restoration of buildings in the City.
Section 3. Safety Clause. The City Council hereby finds, determines, and
declares that this Ordinance is promulgated under the general police power of the
City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of
the public and that this Ordinance is necessary for the preservation of health and
safety and for the protection of public convenience and welfare. The City Council

further determines that the Ordinance bears a rational relation to the proper
legislative object sought to be attained.
Section 4. Severabilitv; Conflictina Ordinances Reoealed. If any section,
subsection or clause of this ordinance shall be deemed to be unconstitutional or
otherwise invalid, the validity of the remaining sections, subsections and clauses
shall not be affected thereby. All other ordinances or parts of ordinances in conflict
with the provisions of this ordinance are hereby repealed.
Section 5. Effective Date. This Ordinance shall take effect fifteen days after
final publication, as provided by Section 5.11 of the Charter.
INTRODUCED, READ, AND ADOPTED on first reading by a vote of 7 to
o on this 22nd day of Julv , 1998, ordered published in
full in a newspaper of general circulation in the City of Wheat Ridge and Public
Hearing and consideration on final passage set for July 27 , 1998, at
7:00 o'clock p.m., in the Council Chambers, 7500 West 29th Avenue, Wheat
Ridge, Colorado.
READ, ADOPTED AND ORDERED PUBLISHED on second and final reading by
a vote of 8 to 0 ,this 27th day of July , 1998.

MEMORANDUM OF ACTION
HISTORIC DESIGNATION d
JOY WILLIAMS BARN 1- T
THIS MEMORANDUM OF ACTION is made and executed by the City of Wheat
Ridge, (the "City") with respect to the following facts
RECITALS
A. On July 27, 1998, the Wheat Ridge City Council adopted Ordinance No 1127,
Series 1998 entitled An Ordinance Designating the Joy Williams Barn, Located
at 11460 West 44th Avenue, as an Historic Landmark in the City of Wheat
Ridge. and
B Ordinance 1127was adopted in accordance with Article VI of Chapter 26 of the
Wheat Ridge Code of Laws; and
C. Article VI, Section 26-613 of the Code of Laws requires the City to record with
the Jefferson County Clerk and Recorder a Memorandum of Action within 15
days of City Council designation of an historic landmark.
NOW, THEREFORE, in accordance with Article VI, Historic Preservation, of the
Wheat Ridge Code of Laws, the City hereby sets forth the following'
1 The Joy Williams Barn, (the "Barn") located at 11460 West 44th Avenue, has
been designated as an Historic Landmark by the City of Wheat Ridge,
2. The legal description of the property which underlies the Barn and is affected by
the historic landmark designation is attached hereto as Exhibit A:
3 The Barn and the property described on Exhibit A attached hereto are subject to
Article VI, Chapter 26 of the Wheat Ridge Code of Laws pertaining to historic landmark
requirements;
4 The provisions in Article VI, Chapter 26 provide, among other things, that with
regard to properties which have historic designation, there are certain limitations on
development, certain maintenance obligations, and certain penalties for violations of or failure
of compliance with the Article;
5. This Memorandum is made solely for purposes of confirming the matters stated
herein for recording purposes This Memorandum does not in any manner alter, amend,
enlarge or reduce the respective rights, privileges, liabilities or obligations of any person.
This Memorandum is executed as of the
