HomeMy WebLinkAboutOrdinance-1998-1130 CITY OF WHEAT RIDGE, COLORADO INTRODUCED BY COUNCIL MEMBER DALBEC Council Bill No. 30 Ordinance No. 1130 Series of 1998 TITLE. AN ORDINANCE AMENDING THE WHEAT RIDGE CODE OF LAWS TO PROVIDE FOR INCREASED PENALTIES FOR TRAFFIC VIOLATIONS. WHEREAS, pursuant to C.R.S. g g 42-4-615 and 42-4-614, any person who commits a moving traffic violation in a designated school zone or a designated maintenance, repair, or construction zone is subject to increased penalties and surcharges; and WHEREAS, the General Assembly of the State of Colorado has sought to enable local governments to designate when areas shall be deemed to be school zones for the purposes of C.R.S. g 42-4-615; and WHEREAS, the Wheat Ridge City Council desires to provide the maximum penalty range available for moving traffic violations in designated school, maintenance, repair, or construction zones, as increased penalties are necessary to protect the safety of school children and construction workers; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO AS FOLLOWS: Section 1. Section 13-2(b) of the Wheat Ridge City Code of Laws IS hereby amended by the addition of the following new section: (14) Part 14, concerning other offenses, is hereby amended by the addition of a new section 1416, which section shall read as follows: 1416. Traffic Violations Committed in Certain Zones "( 1 ) Any person who commits a moving traffic violation in a school, maintenance, repair, or construction zone, which zone has been marked or posted as such, is subject to double the amount of penalty and surcharge imposed For the purposes of KLE\53207\29071J.02 this section, "school zone" means an area that is designated as a school zone with signs posted on the public right-of-way. If the penalty and surcharge has been doubled because a violation occurred within a highway maintenance, repair, or construction zone which was also a designated school zone, the penalty and surcharge shall not be doubled twice. Section 2. Section 13-2(b)(12)(3) of the Wheat Ridge City Code of Laws is hereby amended to read as follows: "(3)Traffic infractions as provided In this code shall be subject to the following penalties: "Minimum Penalty Maximum Penalty "Fine of $10.00 $25.00 Fine of $100.00 $1000.00 "Court costs as authorized by state law shall be added to the fine, Section 3. Safety Clause. The City Council hereby finds, determines and declares that this ordinance is promulgated under the police powers of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative objective sought to be attained. Section 4. Severabilitv. If any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circumstances shall for any reason be judged by a court of competent jurisdiction invalid, such judgment shall not affect, impair or invalidate the remainder of this ordinance or its application to other persons or circumstances Section 5, Effective date, This ordinance shall take effect October 1, 1998, INTRODUCED, READ, AND ADOPTED on first reading by a vote of 6 to 0 on this 17th day of August, 1998, ordered published in full in a newspaper of general circulation in the City of Wheat Ridge and Public Hearing and consideration on final passage set for September 14, 1998, at 7 o'clock pm, in the Council Chambers, 7500 West 29TH Avenue, Wheat Ridge, Colorado, 80215.
