HomeMy WebLinkAbout05/30/1974 MINUTES May )0, lG74 The two hundred and forty-third regular meeting of the Wheat Ridge Council was called to order by Mayor Paul B Abramson at 7 30 p m 7390 West 38 Avenue City at Aldermen attending were Mary Jo Cavarra, Joseph Donaldson, Robert Howard, Calvin Hulsey, Larry Merkl and Louise Turner Also attending were Mayor Paul Abramson, City Administrator John Jerman, City Attorney William McCarthy, City Clerk Elise Brougham, staff and inter- ested citizens Motion by Alderman Turner "I move that the reading of the Minutes of May 23, 197!+ be dispensed with, and that they be approved as printed" Motion was seconded by Alderman Cavarra and tied 3-3 Aldermen Howard, Hulsey and Merkl voted "nay" Mayor Abramson voted "Aye" and MOTION PASSED 4-3 Public Comment was made by the following Mrs Ellen Runyan of 3695 High Court and },lX's Shannon Geis of !r290 Otis stated they had a proposal for walkways which would caver Stevens Elementary School, Sts Peter and Paul School, and Wheat Ridge Jr High and had sent out questionnaires to parents for their ideas as to where the walkways should be They thanked Aldermen Howard, Hulsey, City Engineer Larry TJu:r.a,' 'iTl 11,~ Taylor who ,'lad helped them, and they presented a map drawn up by the City staff which indicated the number of children crossing at intersections and they requested for their area specifically,walkways in the following areas 41 Avenue from Reed to Fenton High Court from '~8 Avenue to ')') Avenue and on Teller from l'l Avenue to ~2 Avenue; and on Reed Street by the school Mrs Julia Young of 4<50 Tabor who complained that there werp dogs loose in her neighborhood and stated she had been knocked down in her own yard by a neighbor's dog, and requested that the Animal Wardens patrol the area more often Alderman HUlse~ stated that the citizens on Pierce Street from approximately 48 Avenue to 4 Avenue signed a petition for curb and gutter at their own expense, and he requested that the Ci.ty Engineer and public Works Director look into the engineering for the sidewalk etc , and that this street was scheduled for paving and that they wanted the curb and gutter first 15 of the 18 residents had signed for the curb and gutter Mr W W Weisendorf, of 47~0 Pierce Street stated he was one of the citizens involved requesting the curb and gutter and thanked Alderman Howard and Hulsey and the Mayor for their cooperation Presentation of paperweight momentoes and letters of appreciation from the Mayor were presented to past and present members of the Civil Service Commission and the Historical Committee Members present to accept the awards were Frank Cosolo, Kent Davis, Miss Joy Clapp, Inez Dorsey, Dr C Jacobson, Elwyn Kiplinger and Naomi K. Olson Dr Jacobson spoke briefly on the Historical Committee's activities Public Hearing for the application of a new 5 2% package beer license for Wheat Ridge Kwik Stop at lO~90 West 38 Avenue Attorney Ben Loye represented the applicant Mr. Paul Dalpes of 11210 West 60 Avenue who was present Mrs ~~ry Sullivan of 3420 Harlan Street gave a report on a city survey of the neighborhood she conducted with the results as follows 100 people were contacted - 51 were for the issuance of the license 35 were against and 14 had no opinion Attorney Ben Loye had the following people testify Mr Jerry Johnson and Mr Howard Tolman both of whom had circulated petitions regarding the license Mr Jerry Kitzsmiller of 8200 N Shpridan, Apt 207 who was the store manager, and Mr Paul Dalpes, leasee of the store rk presented the petitions, plan of store interior and map showing the one mile radius and outlets as exhibits Mr Harve Clements, Court Reporter was present and recorded the hearing Speaking ~n favor of the issuance of the license was MINUTES - May 30, 1974 - Continued -2- Mrs. Nancy Snow of ll155 West 40 Avenue stated it was a reputable business and was welJ-run and that the closest school was one for the retarded and that the pupils were well-supervised This subsequently brought up the question if this school was 500 feet from the outlet, and it was determined that Mr Loye would present measurement next week Speaking in Opposition was Mrs Krager of 3530 Miller COlrrt who felt there were enought outlets in the area and that with the schools i the area the children 1alk by and frequent the store and she objected to the store having beer for sale with some of the clientele being of impressionable age, and that west of the store is a grocery store that does not sell alcoholic beverages and it is still in business and does not need a license to compete Motion by Alderman Merkl "I move that the Council take the issuance of the 3 2 package beer license for Hheat Ridge Kwik Stop at 10390 West 38 Avenue under advisement for one week, during which period Mr Loye will present evidence if the school is within 500 feet or is not within 500 feet of the location, and that a decision be rendered at the next Council meeting" Motion was seconded by Alderman Donaldson and passed 6-0 Resolution No 312 supporting the Denver Regional Council of Governments as planning agency for coordination of a waste treatment management system for the area was introduced by Alderman Cavarra and was read Motion by Alderman Donaldson "I move that Resolution No 312 be adopted " Motion was seconded by Alderman Merkl and passed 6-0 Resolution No. 313 endorsing the acquisition of the property located below the Maple Grove Dam by the City of Lakewood with the City of Hheat Ridge offering cooperation in the acquisition cost etc was introduced by Alderman Merkl and was read It was pointed out that this area should be kept open space in view of the Lena Gulch Study and t~lat the exact amount of contribution would be brought up at a lat.er da.L for dbeu,;si 11. l.., lac~~ :a )f 2525 West 29 Avenue stated he felt this land needed to remain open space Motion by Alderman Turner "I move that Resolution No 313 be adopted " Motion was seconded by Alderman Cavarra and passed 6-0 Application for a Special Events Permit to sell 3 2% beer August 23-24,1974 by the Wheat Ridge Carnation 'Festival 'lt West 38 Avenue and High Court during the festival was presented by Attorney Benjamin Loye Motion by Alderman Donaldson "I move we grant the request for a 2 day "l 2% beer license for the Hteat Ridge Carnation Festival from noon August 23, 1974 to 11 30 p.m August 24, 1974 and that a fee of $1 00 be paid" Motion was seconded by Alderman Hulsey and passed 6-0 Reconsideration of Resolution No 28l setting up a Business and Industrial Relations was scheduled next on the Agenda Motion by Alderman Howard "I move we go on to the next item on the Agenda " Motion was seconded by Alderman Donaldson and passed 4-2 Aldermen Turner and Hulsey voted "nay fI There were no appointments for the three vacancies on the Business and Industrial Relations Committee City Administrator John Jerman stated that a small footage of easements needs to be negotiated for the Urban Systems Application regarding Pierce Street from 32 Avenue to 38 A>renue for i+ foot sidewalks Glen Taylor, Public Works Director said there ~s some existing sidewalk whi.ch is 2 8 feet wide which would need to be torn out MINUTES May 30, 1974 - Continued , -.)- Motion by Alderman Merkl "I move that we allow Mr Taylor to 130 in for the easements necessary to complete this project as submitted to DRCOG" Motion was seconded by Alderman Donaldson and passed ,)-l Alderman Turner voted "nay " Mr Jerman announced that the Albert E Anderson Community Building should be ready for the Municipal Court on July I, and he suggested that Council should initiate the Chambers by using them the week before, June 27th Council agreed to hold their first meeting in the building June 27th Alderman Cavarra stated that Council had received a letter from the Home Builders Assoc ree;arding setting up a Citizen's Co~~ittee and that this be put 0:1 the June 6, 1')74 Study Sesssion A letter from the Office of the State Auditor acknowledging receipt of the City's Audit Report was acknowledged It was announced that there would be an executive City Council and the Mayor following the meeting to the Minutes regarding the action taken at this session for only the A statement is attached meetine; Meeting was adjourned at 9 30 p m / APPROVED -, , I). f- -I-rl[, -4- S TAT E MEN T .ay 30, 1974 - '"'.I."U TES - Continued At an executive session held following the regular City Council meeting on Thursday, May 30, 1974, and attended by the Mayor and Council Members only, the Council reached a decision to terminate the services of Walter T. Rybkowski, Director of Planning, with provisions for terminal pay. ....,,;\.,. The Council then directed the City Administrator to notify Mr. Rybkowski of this decision, and accordingly, Mr. Rybkowski Was relieved of all ,\ duties and responsibilities effective Friday, May 31, 1974, at 9 00 a.m. Council has further directed the City Administrator to develop a profes- sional recruitment procedure on an open competitive basis which will enable the City to hire a qualified replacement as soon as possible. Council further directed that the duties of the position of Director of Planning be incorporated into a new position to be called Director of Community Development and that the newly established Community Development Department under this plan include a Planning Division, a Building Inspection Division, and a Code Enforcement Division. In the interim while recruitment for the new position is in process, the Planning Staff Section Heads will report directly to the City Administrator, and the present Planning functions of Comprehensive Planning, Zoning Administration and Internal Management will be headed by existing staff personnel who are currently performing these duties.
