TITLE: AN ORDINANCE AMENDING CHAPTER 13, ARTICLE IV, PARKING
PERMITS IN RESTRICTED AREAS IN THE WHEAT RIDGE CODE OF
LAWS
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO, THAT.
Section 1. Section 13.62, Description of Restriction., is hereby amended as
follows:
(c) Motorcycles, mopeds and other two-wheeled vehicles AS WELL
AS TEMPORARY SERVICE AND UTILITY VEHICLES INCLUDING BUT NOT LIMITED
TO LANDSCAPING, PLUMBING, ETC. shall be exempt from this section.
(d) The Director of Public Works shall determine the dates and
times of day that the restrictions are in effect ba3ed upon the dote3 and hourG of
operation of the ::;enior high Gehool and the neighborhood FOR EACH SPECIFIC
RESTRICTED PARKING AREA.
Section 2. Section 13.63. Restricted Parking area defined., is amended to
read as follows:
Section 13.63: DESIGNATION OF Restricted Parking area.
(1) The block or some part thereof shall fall within one-half mile of
the closest property line of the senior high school OR WITHIN TWO BLOCKS OF
AN ELEMENTARY SCHOOL OR MIDDLE SCHOOL CAUSING THE PARKING
CONFLICTS.
(4) THE DIRECTOR OF PUBLIC WORKS SHALL HAVE THE
DISCRETION TO GRANT OR DENY THE PETITION FOR DESIGNATION, TAKING
INTO CONSIDERATION THE SAFETY OF SCHOOL CHILDREN THE DIRECTOR'S
DECISION MAY BE APPEALED TO THE CITY COUNCIL BY THE FILING OF A
PETITION, SIGNED BY THE PROPERTY OWNERS OF TWO-THIRDS OF THE
DWELLINGS WITH FRONTAGE ON THE BLOCK. THE PETITION FOR APPEAL
MUST BE FilED, IF AT ALL, NO LATER THAN THIRTY DAYS FOLLOWING THE
DIRECTOR'S DECISION. THE CITY COUNCil SHALL CONSIDER THE PETITION AT
A PUBLIC MEETING. THE ACTION OF THE COUNCIL (OR THE DIRECTOR, IN THE
EVENT NO APPEAL IS TAKEN TO THE COUNCil) SHALL BE FINAL.

Section 3. Section 13.66. Removal of designation as restricted parking
areas, is amended to read as follows'
The director of public works shall have the discretion to remove the
designatIOn of a block as a restricted parking area if any of the following conditions
occur:
(1) By virtue of closure of the school or change in use of the
property, the block or some part thereof is no longer located within one-half mile of
the closest property line of the senior high school OR WITHIN TWO BLOCKS OF
AN ELEMENTARY SCHOOL OR MIDDLE SCHOOL CAUSING THE PARKING
CONFLICTS; or
Section 4. Safety Clause The City Council hereby finds, determines, and
declares that this Ordinance is promulgated under the general police power of the
City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of
the public and that this Ordinance is necessary for the preservation of health and
safety and for the protection of public convenience and welfare. The City Council
further determines that the Ordinance bears a rational relation to the proper
legislative object sought to be attained.
Section 5. Severabilitv. If any clause, sentence, paragraph, or part of this
Code or the application thereof to any person or circumstances shall for any reason
be adjusted by the court of competent jurisdiction invalid, such judgment shall not
affect application to other persons or circumstances.
Section 6. Suppression Clause. If any provision, requirement or standard
established by this Ordinance is found to conflict with similar prOVISions,
requirements or standards found elsewhere in the Code of Laws of the City of
Wheat Ridge, which are in existence as of the date of adoption of this Ordinance,
the provision, requirements and standards herein shall supersede and prevail.
Section 7. This Ordinance shall take effect 15 days after final publication

full in a newspaper of general circulation in the City of Wheat Ridge and Public
Hearing and consideration on final passage set for 11m" 14 , 1999, at
7:00 o'clock p.m., in the Council Chambers, 7500 West 29th Avenue, Wheat
Ridge, Colorado.
READ, ADOPTED AND ORDERED PUBLISHED on second and final reading by
