(WCA-99-0t) BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO. THAT Section 1: SectIOns 5-34 through 5-81 of the Code of Laws of the CIty of Wheat Ridge are hereby amended as follows Article 1II Technical Codes Sec Sec Sec Sec Sec 5-34 5-42 5-43 5-77 5-81 Authonzed ApplIeants House Movmg Permits Drawings and Speclfieations National Eleetnc Code Sign and Wreekmg Permit Fees ARTICLE III. TECHNICAL CODES Sec. 5-34. Authorized applicants. Only persons duly lIcensed under the terms and provIsions of thIS chapter may apply for a permIt, and such lIcensees may apply for and be Issued permIts to perform only such 'vork as they are entItled to perform under theu respective lIcenses, Any applIcation for a permIt filed m derogatIon of thIS chapter shall be deemed to have been filed with fraudulent 1I1tent and shall be tl nullity considered null and void. Notwithstanding the foregoing and 111 additIon th.:reto, the follow1l1g persons shall be deemed to be authorized applIcants ( I ) Any person who owns a group f R bmlding may make applicatIon for permIt to enlarge, remodel, alter, repaIr, improve, convert or demolish such bmldmg. Upon Issuance of a permIt hereunder all such work authOrIzed shall be perfOlmed personally only by such person and shall be performed in accordance \vith all the reqmrements of thIS ehapter Sec. 5-42. House moving permits. (b) Each house movmg permIt shall be assessed a one hundred dollar ($ I 00 0(1) - processmg fee for Issuance of the permIt which shall be due and payable at tIme of applIcatIon for the permIt. In addition to the processmg fee, the permIttee shall provIde !l fi ve htllldred cl511!lI ($500,000) a fifteen thousand dollar ($15,000.00) bond or msuranee certificate or other sUItable secunty to the CIty as a guarantee to the cIty that any damages to publIc Improvement:; are repaIred to new condItIon. Sec. 5-43. Drawings and specifications (d) Disposal afierfinal in.lpection After finalmspection has been made upon completIon of the work approved m a set of drawll1gs and speCIficatIOns, the dIVIsion cop~ of such drawmgs and speClfieatlons shall be disposed of 111 the followmg manner (I) All drawings and speelfications pertaining to commercial, residential (4 -plex or larger), and cIty-owned bUIld1l1gs, struetures or utIlitIes shall be kept m a permanent file (2) ether Residential drawings and specifications may be disposed of at any tIme after tHO (2) ye!l13 I,ave 180 days has elapsed from the date of Issuanc,: of the pClffilt. Certificate of Occupancy. Sec. 5-77. (c) Purpose The purpose of thIS sectIon IS to provide mll1imum standards to ~afeguard lIte or lImb, health, property, and publIc welfare by regulatmg and controllmg the deSign, constructIon, qualIty of matenals, use and occupancy, locatIon and ma1l1tenance of all bUIldmgs, structures and utIlItIes and certam equipment speCltically regulated herem. (d) Electriwl permitlees Electrical permIt fees 113 go v cfflcd by the state deEtneal board shall be as follows. All fees, c.<:eept for llBpcetlOll Ifl mobile homes lu,d travel parks, ,hall be computed on the dollar value of the electricalll1stallation, inelud1l1g tIme and material (total cost to the customer) and such fees shall be computed based upon the deetncal fee strueturc published by the State of Colorado Section 107 and Table I-A of the Uniform Building Code at tIme of obtainmg the permit. Sec. 5-81. Sign and wrecking permit fees. (a) Sign tees shall be fifteen dollars ($15 00) per sign for (smgle or d5ublc face-} single or double face changes only. All new or replacement signs shall have fees based on the 2 valuation ofthe installation (total cost to the customer) and such fees shall he computed based on Section 107 and Table I-A of the Uniform Building Code. Wrecking permit fees shall be ten dollarg ($ I 0 00) fifty dollars ($50.00) per address. Section 2. Previous Amendments. All prevIOus amendments to Seetion 5 of the Code of Laws shall remam III effect unless otherwise amended as part OfthIS ordmance Section 3. Vested Property Rie:hts. Approval of these Amendments to the U mform Buildmg Code and adoptIOn of these 1I1to the Code of Laws of the City of Wheat Ridge by reference, does not create a vested property right. Vested property nghts may only anse and accrue pursuant to the proVISIons of SectIOn 26(c) of AppendIX A and the Code of Laws of the CIty of Wheat Ridge. Section 4. Safety Clause. The City CouncIl hereby finds, determ1l1es, and dcclares that this ord1l1ance is promulgated under the general polIce power of the CIty of Wheat RIdge, that It IS promulgated for the health, safety, and welfare of the public and that this ordinance IS necessary for the preservation of health and safety and for the protectIOn of public convemence and welfare. The City CounCIl further determines that the ordinance bears a ratIonal relatIOn to the proper legIslatIve objeet sought to be attamed. Section 5. Severability. If any clause, sentence, paragraph, or part of thIS Building Code or the applIcation thereof to any person or CIrcumstances shall for any reason be adJusted by a court of competent junsdlction mvalid, such judgment shall not affect applicatIOn to Nher persons or cIrcumstances. Section 6. Supersession Clause. If any proVIsion, requirement or standard establIshed by thIS Ordinance IS found to eonflict WIth SImilar prOVISIOns, requirements or standards found elsewhere m the Code of Laws ofthe CIty of Wheat RIdge, whleh are in eXIstence as ilfthe date of adoptIOn of this Ord1l1ance, the proviSIOns, requirements and standards herem shall supersede and prevml Section 7.
