TITLE.
AN ORDINANCE SUBMITTING A PROPOSED AMENDMENT TO
THE WHEAT RIDGE HOME RULE CHARTER TO THE VOTERS
OF THE CITY PURSUANT TO CHARTER SECTION 16.8(b),
CONCERNING UNLIMITED TERMS OF OFFICE FOR THE CITY
CLERK
WHEREAS, Section 16.8(b) of the Charter permits the City Council to initiate
charter amendments; and
WHEREAS, the Council wishes to place before the voters at the November,
1999 general election a ballot measure to provide for term limitations for the City
Clerk.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO, AS FOLLOWS:
Section 1. Pursuant to Charter Section 16.8(b), the following proposed
amendment to the Wheat Ridge City Charter is hereby submitted to the voters of
the City for their consideration at the general election to be held on November 2,
1999:
Amend Section 3.7 of the Charter as follows:
Sec. 3.7. Election of city clerk.
The city clerk shall be elected by a majority vote of
the electors of the City of Wheat Ridge at each general
municipal election, and shall have the same qualifications
as members of the council Hislher term of office shall be
for two (2) years and shall commence on hislher taking
the oath of office at the ensuing organizational meeting of
the city council held after the election in the year elected
and shall continue during the term for which helshe shall
have been elected until hislher successor shall have been
elected and duly qualified. THERE SHALL BE NO

LIMITATION UPON THE NUMBER OF CONSECUTIVE
TERMS OF THE OFFICE OF CITY CLERK WHICH MAY BE
SERVED BY ANY PERSON.
Section 2. Ballot Title. The ballot title for the proposed Charter Amendment
shall read as follows:
SHALL THE HOME RULE CHARTER OF THE CITY OF WHEAT RIDGE, COLORADO,
BE AMENDED TO PROVIDE FOR NO LIMITATION ON THE NUMBER OF
CONSECUTIVE TERMS WHICH MAY BE SERVED BY THE CITY CLERK?
Section 3. Safetv Clause. The City Council hereby finds, determines, and
declares that this Ordinance is promulgated under the general police power of the
City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of
the public and that this Ordinance is necessary for the preservation of health and
safety and for the protection of public convenience and welfare The City Council
further determines that the Ordinance bears a rational relation to the proper
legislative object sought to be attained.
Section 4. Severabilitv. If any clause, sentence, paragraph, or part of this
Ordinance or application thereof to any person or circumstances shall for any
reason be judged by a court of competent jurisdiction invalid, such judgment shall
not affect, impair or invalidate the remainder of this Ordinance or its application to
other persons or circumstances.
Section 5. Effective Date. This Ordinance shall take effect September 7,
1999.

on this 9th day of August, 1999, ordered published in full in a newspaper of general
circulation in the City of Wheat Ridge and Public Hearing and consideration on final
passage set for August 23, 1999, at 7:00 o'clock p.m., in the Council Chambers,
7500 West 29th Avenue, Wheat Ridge, Colorado.
READ, ADOPTED AND ORDERED PUBLISHED on second and final reading by
