TITLE:
AN ORDINANCE PROVIDING FOR THE AMENDMENT OF
THE GEORGE T. SANDERS COMPANY PLANNED
INDUSTRIAL DEVELOPMENT OUTLINE AND FINAL
PLAN, FOR CERTAIN PROPERTY LOCATED AT 10201
WEST 49TH AVENUE WITHIN THE CITY OF WHEAT
RIDGE, COLORADO, PURSUANT TO SECTION 26-25(IX)
OF THE WHEAT RIDGE CODE OF LAWS (WZOO-02).
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO, THAT
Section 1. Fllldmgs of Fact
(A) Proposed uses for the Planned lndustnal Development are not expected to result
III slgmficant ncgatIvc Impacts to sUlToundmg propeliy owners and/or property
users.
(B) The use of the property IS compatible WIth surroundlllg uses and planned uses III
the area.
(C) The amendment request IS conSIstent With changes III the character III the area.
(D) Adequate Infrastructure wIll be aVaIlable to serve the sIte
Section 2. The George T Sanders Planned IndustrIal Development Outlllle and Flllal
Dcvelopment Plan, bemg property described III attached ExhibIt A, IS hereby amended, subJect to
the condltlOn(s) set forth below
I The applicant wIll be reqUIred to constmct curb, gutter and sIdewalk along the Miller
Street frontage of the property
Section 3. Vested Property Rn;hts. Approval of thIs rc-zonlllg does not create a vested
property nght. Vested property nghts may only arIse and accrue pursuant to the prOVISIOns of
SectIon 26( c )of AppendIx A and the Code of Laws of the CIty of Wheat RIdge
Section 4. Safety Clause. The CIty CouncIl hereby finds, detenmnes, and declares that
thIS ordlllance IS promulgated under the general polIce power ofthc CIty of Wheat RIdge, that It
IS promulgatcd for the health, safety, and welfare of the publIc and that thIS ordma~
necessary for the preservatIon of health and safety and for the protectIon of publIc convemence
and welfare The CIty Council further detcnmncs that the ordlllance bears a rational relatIon to
the proper legIslative obJect sought to be attallled.
Section 5. Severabll1ty. If any clause, sentence, paragraph, or part of this Zomng Code
or the applIcatIOn thereof to any person or circumstances shall for any reason be adJusted by a
court oCcompctcntJunsdlctlOn mvalId, such Judgment shall not affect applIcatIOn to othcr
persons or circumstances
Section 6. SupersessIOn Clause. If any proVIsion, reqUIrement or standard establIshed by
this Ordmance IS found to conflict With SimIlar provISIOns, requirements or standards found
clsewhere m the Code of Laws of the CIty of Wheat Ridge, which are III eXistence as of the datc
of adoption of thIs Ordlllance, the proVISIOns, rcqulrements and standards herem shall supersede
and preVaIl
Section 7. ThIs ordlllance shall takc cffect 15 days alter final publIcatIOn
