TITLE:
AN ORDINANCE PROVIDING FOR THE APPROVAL OF
REZONING FROM RESTRICTED COMMERCIAL-ONE
TO RESIDENTIAL-TWO A FOR PROPERTY LOCATED
AT 3767 HARLAN STREET, CITY OF WHEAT RIDGE,
COUNTY OF .JEFFERSON, STATE OF COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO. THAT.
Section 1. Upon application by Edwlll S Gibson, approval of a rezoning in Wheat JUdge,
Colorado, Case No WZ-00-04 and based on recommendatIOn for approval from the Wheat
JUdge Plannlllg CommIssIon and pursuant to findlllgs made based on testImony and eVIdence
presented at public hearlllg before the Wheat RIdge CIty Council, Wheat Ridge maps are hereby
amended to exclude from the Restricted Commercial-One zone distrIct and to include in the
Residential Two-A zone district the followlllg described land:
A PARCEL OF LAND IN THE NE 1/4 OF THE NW 1/4 OF SECTION 25, TOWNSHIP 3
SOUTH, RANGE 69 WEST OF THE 6th P.M., BEING MORE PARTICULARLY DESCRIBED
AS FOLLOWS COMMENCING AT THE NORTH QUARTER (1/4) CORNER OF SECTION
25, THENCE SOUTHERLY ALONG THE EAST LINE OF NW 1/4 OF SECTION 25, A
DISTANCE OF 130 FEET, THENCE WESTERLY ON A DEFLECTION ANGLE RIGHT OF
90000'00" A DISTANCE OF 30 FEET TO A POINT ON WEST RIGHT OF WAY LINE OF
HARLAN STREET, SAID POINT BEING TRUE POINT OF BEGINNING; THENCE
WESTERL Y AND PARALLEL WITH THE NORTH LINE OF NW 1/4 OF SECTION 25, A
DISTANCE OF 135.50 FEET, THENCE SOUTHERLY AND PARALLEL WITH EAST LINE
OF NW 1/4 OF SECTION 25 A DISTANCE OF 124.20 FEET, THENCE EASTERL Y AND
PARALLEL WITH NORTH LINE OF NW 1/4 OF SECTION 25 A DISTANCE OF 135.50
FEET TO A POINT ON THE WEST RIGHT OF WAY ON HARLAN STREET; THENCE
NORTHERL Y ALONG SAID WEST RIGHT OF WAY AND BEING PARALLEL WITH
EAST LINE OF THE NW 1/4 OF SECTION 25 A DISTANCE OF 12440 FEET TO TRUE
POINT OF BEGINNING
Section 2. Vested Property Rights. Approval of thIs rezoning does not create a vested
property right. Vested property rights may only arise and accrue pursuant to the provIsions of
Section 26(G)ofthe Code of Laws of the CIty of Wheat Ridge
Section 3. Safety Clause. The City Council hereby finds, determines, and declares that
this ordmance is promulgated under the general polIce power of the CIty of Wheat RIdge, that It
IS promulgated for the health, safety, and welfare of the publIc and that this ordinance is
necessary for the preservation of health and safety and for the protectIOn of publIc convemence

and welfare The City CounCIl further determmes that the ordmance bears a ratIOnal relatIOn to
the proper leglslatlve obJect sought to be attamed.
Section 4. SeverabIlIty. If any clause, sentence, paragraph, or part of thIs Zonmg Code
or the application thereof to any person or cIrcumstances shall for any reason be adjusted by a
court of competent Jurisdiction invalId, such Judgment shall not affect applicatIOn to other
persons or CHcumstances.

Section 5. Supersession Clause. If any prOVIsion, reqUIrement or standard establIshed by
thIs Ordmance is found to conflict with simIlar proVISIons, reqUIrements or standards found
elsewhere in the Code of Laws of the City of Wheat RIdge, whIch are in eXIstence as of the date
of adoption of thIs Ordinance, the proVIsions, reqUIrements and standards herelll shall supersede
and prevml.
Section 6. ThIs ordlllance shall take effect ~ days after final publIcation.
