HomeMy WebLinkAboutOrdinance-2001-1229 CITY OF WHEAT RIDGE, COLORADO INTRODUCED BY COUNCIL MEMBER Edwards Council Bill No. 17-2001 Ordinance No. 1229 Series of 2001 TITLE: AN ORDINANCE REPEALING AND REENACTING CHAPTER 25 OF THE WHEAT RIDGE CODE OF LAWS, ENTITLED "URBAN RENEWAL." WHEREAS, the City Council has created an Urban Renewal Authority pursuant to C.R.S. ~ 31-25-101, etseq.; and WHEREAS, the City Council wishes to conform Chapter 25 of the Code of Laws to the state statute governing urban renewal authorities. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO: Section 1. Chapter 25 of the Wheat Ridge Code of Laws, entitled "Urban Renewal," is hereby repealed and reenacted to read as follows: ARTICLE I. IN GENERAL Secs. 25-1 - 25.20. Reserved. ARTICLE II. URBAN RENEWAL AUTHORITY Sec. 25-21. Findings of fact. Based upon all of the evidence presented to it at a public hearing, notice of which was duly published, and after considering such factors as the physical condition and age of the buildings in particular areas of the city, the aggravated traffic problems created by present street layouts in portions of the city, and the impairment of sound commercial growth patterns within portions of the city and their adverse effect upon the future development of the city, the city council hereby finds as follows: (1) One( 1) or more blighted areas exist within the city. ; and (2) The acquisition, clearance, rehabilitation, conversion, development, redevelopment or a combination thereof, of such areas is necessary in preserving and ensuring the public health, safety and welfare of the residents of the city. GED\53027\388534.03 1 Sec. 25-22. Declaration of need for authority. The city council hereby declares that it is in the public interest for an urban renewal authority, created pursuant to the Urban Renewal Law IC.R.S. !i 31- 25-101 et seq.], to function within the city and to exercise the powers provided therein, except as the same may be limited, constrained or proscribed by any approved and adopted urban renewal plan. Sec. 25-23. Urban Renewal Authority - Rights and duties generally. The Wheat Ridge Urban Renewal Authority is hereby organized and established. Such authority is hereby vested with all of the rights contained, and is authorized to carry out all of the duties and functions as provided in the Urban Renewal Law IC.R.S. !i 31-25-101 et seq.l, as it now exists or as amended in the future, unless such powers and authorities are limited or constrained by or within any approved urban renewal plan. Sec. 25-24. Same - Appointment of members; number. The authority shall consist of eleven (11) members, two (2) of such members being from each of the existing, or hereafter altered, city council districts, and three (3) members to serve at large. The at large members shall include one city council member. Each appointment to the authority shall be made by the mayor subject to approval by majority vote of the entire city council. The term of office of each member shall be five (5) years. Any member who shall change his personal residence to an address outside the city or outside the district he represents shall cease to be a member of the authority and his seat shall automatically be deemed vacant as of the date on which he ceased to be a resident of the city or of the district. A member whose term has expired shall continue to hold office until his successor has been appointed and has qualified. Terms of office shall be staggered so that the term of at least one member shall expire each year. The city council may appoint any number of ex-officio nonvoting members to serve for terms at the pleasure of the city council. Sec. 25-25. Reserved. Section 2.Safetv Clause. The City Council hereby finds, determines, and declares that this Ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public and that this Ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the Ordinance bears a rational relation to the proper legislative object sought to be attained. Section 3. Severabilitv: Conflictina Ordinances Reoealed. If any section, subsection or clause of this ordinance shall be deemed to be unconstitutional or GED\53027\38853403 2 otherwise invalid, the validity of the remaining sections, subsections and clauses shall not be affected thereby. All other ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 4. Effective Date. This Ordinance shall take effect fifteen days after final publication, as provided by Section 5.11 of the Charter. INTRODUCED, READ, AND ADOPTED on first reading by a vote of 6 to 2 on this 24th day of September, 2001, ordered published in full in a newspaper of general circulation in the City of Wheat Ridge and public hearing and consideration on final passage set for October 8, 2001, at 7:00 o'clock p.m., in the Council Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado.
